ACTION for annulment of the Council's decision of 8 May 2000 to reject the proposal for a Council Regulation (EC) imposing a definitive anti-dumping duty on imports of certain parts of television camera systems originating in Japan, submitted by the Commission of the European Communities on 7 April 2000 (document COM (2000) 195 final),THE COURT OF FIRST INSTANCE OF THE EUROPEAN COMMUNITIES (Fourth Chamber, Extended Composition),
having regard to the written procedure and further to the hearing on 1 December 2004,
gives the following
-�The Council confirmed the absence of a simple majority in favour of the Commission proposal submitted to the Council on 10 April for a regulation imposing a definitive anti-dumping duty on imports of certain parts of television camera systems originating in Japan.-�
- annul the Council-�s decision of 8 May 2000 to reject the proposal for a Council Regulation (EC) imposing a definitive anti-dumping duty on imports of certain parts of television camera systems originating in Japan (document COM (2000) 195 final); - order the Council to pay the costs
- rule on the action for annulment in the light of the judgment of the Court of Justice in Case C-76/01 P.
The sole plea: failure to state reasons in the contested decision
On those grounds,
THE COURT OF FIRST INSTANCE (Fourth Chamber, Extended Composition)
hereby: 1. Annuls the Council-�s decision of 8 May 2000 to reject the proposal for a Council Regulation (EC) imposing a definitive anti-dumping duty on imports of certain parts of television camera systems originating in Japan, submitted by the Commission of the European Communities on 7 April 2000 (document COM (2000) 195 final). 2. Orders the Council of the European Union to pay the costs.
