The Old Canal Company Limited v James Russell Tate (Alteration and rectification of the register : Mistake) [2017] UKFTT 642 (PC) (26 July 2017)
Application under Schedule 4 of the 2002 Act to remove an area of land adjacent to the North Walsham and Dilham Canal from the title plan of the Respondent's land on the grounds that the land had been mistakenly shown as part of the Respondent's title. The claim failed because the Applicant (the owner of the Canal) could not establish that he had paper title to the disputed land. There were no identifying features defining this land on the ground. The real issue was access to the canal bank from the nearby road. The Canal, and the adjoining land, would continue to be shown with general boundaries on their respective title plans.
