Wai Wong v Tania Samantha Levin (Beneficial interests, trusts and restrictions : Resulting trust) [2018] UKFTT 60 (PC) (11 January 2018)


Applicant sought restrictions over three properties purchased in the name of his former partner, the mother of four of his children, in one of which he used to cohabit with her. His case was that the properties had been purchased with a view to eventually funding the establishment of a Buddhist Temple using money given or generated by his followers. The Respondent alleged that she provided the deposit for the purchase of the first property and paid the mortgage with her income. The second two properties were purchased by remortgaging the first one. Held that the Applicant had failed to prove that he had an interest in the properties under an express, constructive or resulting trust and cancellation of the applications directed.
