John Quilligan (Unreported, High Court, Edwards J., 26th July, 2013) Extradition—European arrest warrant—Refusal to surrender—Respondent charged with partially completed, partially attempted professional aggravated theft through burglary under the Criminal Code of the Republic of Austria—European Arrest Warrant Act 2003 (No. 45 of 2003), ss. 10, 13, 16, 21A—s. 21A objection—Whether surrender permissible where final decision to prosecute for offences in European arrest warrant not made—whether s.21A(2) presumption rebutted—insufficient evidence of a cogent nature to rebut s. 21A(2) presumption.
