LOCAL GOVERNMENT (TEMPORARY PROVISIONS) ACT, 1923.

16/05/1923: AUDIT OF LOCAL ACCOUNTS (APPLICATION AND ADAPTATION OF ENACTMENTS) ORDER, 1923

WHEREAS by sub-sections (1) and (2) of Section 20 of the Local Government (Temporary Provisions) Act, 1923 , (hereinafter referred to as " the Act ") the Minister of Local Government is empowered by Order to make such adaptations of any existing enactment relating to any matter dealt with or affected by the Act as appear to him to be necessary or expedient for carrying the Act into effect:

AND WHEREAS the audit of the accounts of local authorities is a matter affected by the Act:

AND WHEREAS it appears to me, the Minister of Local Government necessary for carrying the Act into effect to make the adaptations hereinafter specified in the enactments relating to the said audit:

NOW, THEREFORE, I, the Minister of Local Government do hereby order as follows:—

1. This Order may be cited as " The Audit of Local Accounts (Application and Adaptation of Enactments) Order, 1923."

2. In this Order all words and expressions shall have the same meaning as in the Act.

3. Any provision of any enactment which applies to the Audit of the Accounts of a Board of Guardians or defines the powers and duties of an Auditor thereof, shall apply to the audit of the accounts of any public body established under and in pursuance of any County Scheme and to the Auditor thereof.

4. Any enactment which applies to a local authority the functional area of which is within, or partly within a county to which a County Scheme relates, shall, in so far as it affects such local authority, be adapted so that:

(a) Any reference to an Auditor of Poor Law Unions shall be construed so as to include an auditor of any body to whom the functions connected with the relief of the poor of the Board of Guardians in such county have been transferred by the County Scheme for such County.

(b) Any reference to an Auditor of a specific Poor Law Union or to the Auditor of the accounts relating to the relief of the poor in any Union, where the Board of Guardians of such Union has been abolished by or in pursuance of the County Scheme for such County, shall be read as if it were a reference to the auditor of any of the bodies to whom the functions connected with the relief of the poor of such Board of Guardians in such county shall have been transferred.
