| | THE TEACHERS' PENSION RULES, 1926.

| | Rules made by the Minister for Education with the consent of the Minister for Finance, under Section 11 of the National School Teachers (Ireland) Act, 1879, in relation to the pensions of certain National School Teachers.

| | I, John Marcus O'Sullivan, Minister for Education, in exercise of the power given to me by the National School Teachers (Ireland) Act, 1879, and of every power me thereunto enabling, do hereby make the following Rules:—

| | 1. (a) Where a teacher enlisted for temporary service in the National Forces (naval or military) or the Defence Forces of Saorstát Eireann after the 6th day of December, 1921, (whether or not such teacher held an appointment in any national school at the date of such enlistment), such teacher, while serving in any such forces, pursuant to such enlistment, shall be deemed to be in service as a teacher for the purposes of the Teachers' Pension Rules, 1914, and the period of such temporary service in such forces shall be reckoned as service as a teacher for the purposes of the said Rules.

| | (b) Where any such teacher as aforesaid has been unable immediately upon resignation or demobilisation from the forces aforesaid to secure re-appointment as teacher in a national school such teacher shall be deemed to be in service as a teacher for the purposes of the Teachers' Pension Rules, 1914, during the period between the date of such resignation or demobilisation (as the case may be) and the date of such re-appointment (if any), or until the expiration of a period of three months from the date of such resignation or demobilisation (whichever of those periods shall be the less) and such period shall be reckoned as service as a teacher for the purposes of the said Rules, subject, however, in either case to the Minister for Education being satisfied that such teacher could not have secured earlier re-appointment.

| | 2. Where a teacher was in service as such during the European War in a national school as a substitute for a teacher then serving with the British naval or military forces, the period of the service of such teacher in such national school (except such portion (if any) of that period as was after the 31st day of August, 1921) shall, upon payment by such teacher to the Superintendent of the Teachers' Pension Office of Saorstát Eireann of the premiums appropriate to the service of such teacher, be reckoned as service for the purposes of the Teachers' Pension Rules, 1914, and shall be so reckoned whether such teacher did or did not receive his salary in respect of his service as such substitute from the Commissioners of National Education in Ireland out of moneys provided by Parliament.
