THE INDUSTRIAL PROPERTY (AMENDMENT) RULES (No. 3), 1929. | ||
Under and by virtue of the provisions of The Industrial and Commercial Property (Protection) Act, 1927 , the Minister for Industry and Commerce hereby makes the following Rules:— | ||
1.—The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Rules in like manner as it applies to the interpretation of an Act of the Oireachtas passed after the first day of January, 1924. | ||
2.—In these Rules the expression "the Principal Rules" means the Industrial Property Rules, 1927. | ||
3.—These Rules shall come into operation on the date of the making thereof. | ||
4.—Rule 28 of the Principal Rules shall be construed as if the words "French, German, Italian or Spanish" now contained therein were deleted therefrom and the said Rule shall have effect accordingly. | ||
5.—(1) Rule 131 of the Principal Rules shall be construed as if the words "a representation of the mark" now contained therein were deleted therefrom and the said Rule shall have effect accordingly. | ||
(2) The certificate to be issued by the Controller to the applicant on the registration of a trade mark under Rule 131 of the Principal Rules as amended by this Rule shall be in the Form in the Schedule hereto in lieu of the Form No. 4 in the First Schedule to the Principal Rules. | ||
6.—Applications for the registration of the same trade mark in different classes shall be treated as separate and distinct applications and in all cases where a trade mark is registered under the same official number for goods in more than one class, the registration shall, for the purpose of fees and otherwise, be deemed to have been made on separate and distinct applications in respect of the goods included in each class. | ||
7.—These Rules may be cited for all purposes as the Industrial Property (Amendment) Rules (No. 3), 1929, and shall be construed as one with the Principal Rules, and the Principal Rules, The Industrial Property (Amendment) Rules, 1928, The Industrial Property (Amendment) Rules (No. 2), 1928 and these Rules may be cited together as the Industrial Property Rules, 1927 to 1929. | ||
