BY-LAW No. 409 No. 63 or KENMARE DISTRICT | ||
PROHIBITION OF NETTING IN FRESH WATER | ||
I, FIONAN O LOINGSIGH, Minister for Lands and Fisheries, by virtue and in exercise of the powers vested in me by the Fisheries Act, 1925 , and of every other power enabling me in this behalf, do MAKE AND ORDAIN THE FOLLOWING BY-LAW :— | ||
(1) It is prohibited to use any net, save landing nets used solely as auxiliary to lawful angling with rod and line and nets used lawfully for the capture of eels, for the purpose of taking fish or with intent to take fish in the freshwater portion of any river or lake in the No. 63 or Kenmare District. | ||
(2) It is prohibited to put leave or have in possession in or on or near the banks of the freshwater portion of any river or lake in the said District any net of which the use is prohibited by this By-law, but this prohibition shall not affect lawful fishing with nets in tidal waters adjacent to the fresh waters. | ||
(3) Each and every person offending against this By-law shall forfeit and pay for each offence a sum not exceeding five pounds ; and every net used or found contrary to this By-law shall be forfeited. | ||
(4) The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this By-law in like manner as it applies to the interpretation of an Act of the Oireachtas. | ||
(5) This By-law may be cited for all purposes as the Kenmare District Netting By-law, No. 409, 1931. | ||
(6) The By-law by which the use of nets was prohibited in part of the fresh waters of the District made on the first day of May, One Thousand Nine Hundred and Seventeen, is hereby revoked. | ||

Note.—Under the provisions of the Fisheries Act, 1925 , this By-law will come into operation on the twenty-eighth day after the above date. | ||
