BY-LAW No. 425 OYSTER FISHERIES

CROSSOOHA, KINVARRA BAY


I, SEAMAS Ó RIAIN, Minister for Agriculture, by virtue and in exercise of the powers vested in me by Section 28 of the Fisheries Act, 1925 , the Fisheries (Re-distribution of Public Services) Order, 1934, and of every other power enabling me in this behalf DO MAKE AND ORDAIN THE FOLLOWING BY-LAW :—

(1) It shall not be lawful during the period from the first day of December, 1935, to the 30th day of November, 1937, both said days inclusive, to dredge for, take, catch, or destroy any Oyster or Oyster Brood in that part of Kinvarra Bay in the County of Galway which is bounded on the north or seaward side by a straight line drawn from the northern end of the boundary between the Townlands of Doorus Demesne and Crossooha to the northern extremity of Avonagh Island all in the Parish of Kinvarradoorus and Barony of Kiltartan, from thence to Goormeen Rock, and from thence to the western end of the boundary between the Townlands of Tarrea and Ballyclery, both in the Parish of Killeenavarra and Barony of Dunkellin, and on the south by a straight line drawn through the southern extremity of Hags Island adjoining the Townland of Ballybranagan in the Parish of Kinvarradoorus and the Barony of Kiltartan and the centre of Illaunranny adjoining the Townland of Ballyclery in the Parish of Killeenavarra and the Barony of Dunkellin, and continued to the mainland in both directions.

(2) Each and every person offending against this By-law shall forfeit and pay for each offence a sum not exceeding Five Pounds, and any Oyster or Oyster Brood taken in contravention thereof shall be forfeited.

(3) The Interpretation Act, 1923 (No. 46 of 1923), applies as to the interpretation of this By-law in like manner as it applies to the interpretation of an Act of the Oireachtas.

(4) This By-law may be cited for all purposes as the Crossooha Oyster By-law No. 425, 1935.
