CONTROL OF IMPORTS (QUOTA No. 29) ORDER, 1936.

CONTROL OF IMPORTS (QUOTA No. 29) ORDER, 1936.

WHEREAS it is enacted by Section 3 of the Control of Imports Act, 1934 (No. 12 of 1934), that the Executive Council may at any time by order (in that Act called a quota order) prohibit, subject to the provisions of the said Act, the importation into Saorstát Eireann on or after a specified day (in that Act referred to as the commencement of such order) not prior to the date of such order of any particular description or descriptions of goods and that the Executive Council shall, in and by every quota order, appoint the day (not more than six weeks after the commencement of such order) on which the first quota period under such quota order shall commence :

NOW, the Executive Council, in exercise of the powers conferred on them by Section 3 of the Control of Imports Act, 1934 (No. 12 of 1934), and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Control of Imports (Quota No. 29) Order, 1936.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this Order—

the expression " the Act " means the Control of Imports Act, 1934 (No. 12 of 1934),

the word " shoe " includes slipper, sandal, clog, and any other external footwear which does not extend above the ankle of the wearer,

the word " rubber " includes any material which is, in the opinion of the Revenue Commissioners, artificial rubber or an imitation of rubber or contains rubber as an ingredient.

4. Subject to the exceptions and qualifications hereinafter mentioned, this Order applies to shoes which comply with all the following conditions, that is to say :—

(a) the shoes are, in the opinion of the Revenue Commissioners, completely or substantially manufactured, and

(b) the uppers of the shoes are in the opinion aforesaid, made wholly or mainly of canvas or rubber, and

(c) the soles of the shoes are made wholly or partly of rubber, and

(d) the heels of the shoes are not less than one quarter of one inch in height measured on the front face of the heel from the shank or waist to the ground where that height is least on that face.

5. Subject to the exceptions and qualifications mentioned in the next following paragraph of this Order, the importation into Saorstát Eireann on or after the 29th day of January, 1936, of shoes to which this Order applies is hereby prohibited.

6. The prohibition effected by the next preceding paragraph of this Order shall not extend or apply to—

(a) shoes of which the soles are fitted after manufacture with studs made wholly or partly of rubber or metal, or

(b) goloshes, or

(c) shoes which are, in the opinion of the Revenue Commissioners, of a surgical character, or

(d) shoes which are, in the opinion aforesaid, imported for use exclusively in a stage play or other dramatic or musical representation or performance, or

(e) shoes which are imported under and in accordance with a licence in that behalf issued under the Act, or

( f ) shoes to which this Order is precluded by sub-section (4) of Section 3 of the Act from applying.

7. The 2nd day of March, 1936, is hereby appointed to be the day on which the first quota period under this Order shall commence.
