WIDOWS' AND ORPHANS' PENSIONS (CALCULATION OF CONTRIBUTIONS) REGULATIONS, 1936. | ||
The Minister for Local Government and Public Health in exercise of the powers conferred on him by paragraph (c) of Section 13 and paragraph (e) of Section 65 of the Widows' and Orphans' Pensions Act, 1935 , does by this his Order make the following regulations :— | ||
1. These Regulations may be cited for all purposes as the Widows' and Orphans' Pensions (Calculations of Contributions) Regulation, 1936. | ||
2. The Interpretation Act, 1923 , applies to the interpretation of this Order and of the Regulations hereby made thereunder in like manner as it applies to the interpretation of an Act of the Oireachtas. | ||
3. In these Regulations, unless the context otherwise requires, the following expressions have the meanings hereinafter respectively assigned to them : | ||
" the Act " means the Widows' and Orphans' Pensions Act, 1935 ; | ||
" the Minister " means the Minister for Local Government and Public Health. | ||
4. The Regulations shall have effect as from 6th January, 1936. | ||
5. In calculating for the purposes of paragraph (c) of sub-section (1) of Section 13 of the Act the average number of contributions paid by or in respect of an insured person within the meaning of SEÁN T. Ó, a contribution shall be deemed to have been paid— | ||
(i) in respect of every week or part of a week in respect of which a contribution was treated for the purposes of calculating arrears as having been paid under Article (3) of the National Health Insurance (Arrears) Regulations, 1921 ; | ||
(ii) in respect of every week (not comprised in the preceding paragraph) as regards which the Minister is satisfied that the insured person was incapable of work by reason of some specific disease or some bodily or mental disablement. | ||
6. Where contributions in respect of an employed person, which have not been paid on the due dates, are subsequently paid or recovered they shall as on and from the Friday next following the expiration of twenty-eight days after the date on which such contributions have been paid or recovered, be treated as having been paid on the due dates. | ||
