No. 147/1937:

CONTROL OF IMPORTS (QUOTA No. 31) (AMENDMENT) ORDER, 1937.

CONTROL OF IMPORTS (QUOTA No. 31) (AMENDMENT) ORDER, 1937.

WHEREAS it is enacted by Section 11 of the Control of Imports Act, 1934 (No. 12 of 1934), that the Executive Council may at any time by order amend or revoke any quota order or other order previously made under the said Act, including an order made under the said Section 11 amending a previous order :

AND WHEREAS by Section 2 of the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937), it is enacted that the Executive Council may, in and by a quota order, do all or any of the following things, that is to say :—

(a) exempt from the prohibition effected by such order goods imported for a specified purpose or in specified circumstances or in a specified manner or in limited quantities ;

(b) effect any such exemption as is mentioned in the next preceding paragraph either directly or by way of an authorisation to the Minister for Industry and Commerce or to the Revenue Commissioners ;

(c) attach to any such exemption any specified limitation or condition, whether as to quantity, time, proof, or otherwise, and in particular a condition requiring the Minister for Industry and Commerce or the Revenue Commissioners to be satisfied of specified matters before the exemption takes effect in respect of any particular goods ;

(d) give to the Minister for Industry and Commerce or to the Revenue Commissioners power, duty, or jurisdiction to determine whether particular goods are or are not entitled to the benefit of any particular such exemption ;

(e) authorise the Minister for Industry and Commerce or the Revenue Commissioners to impose conditions (whether precedent or subsequent) to be complied with by persons claiming or receiving the benefit of any such exemption :

AND WHEREAS it is enacted by sub-section (1) of Section 3 of the Control of Imports (Amendment) Act, 1937 , that the Executive Council may amend, under Section 11 of the Control of Imports Act, 1934 , any quota order made before the passing of the Control of Imports (Amendment) Act, 1937 , by inserting in such quota order any provision which could lawfully have been inserted therein if that Act had been in force when such quota order was made :

AND WHEREAS on the 27th day of August, 1936, the Executive Council, in exercise of the powers conferred on them by Section 3 of the Control of Imports Act, 1934 , made the Control of Imports (Quota No. 31) Order, 1936 (Statutory Rules and Orders, No. 238 of 1936) :

NOW, the Executive Council, in exercise of the powers conferred on them by the Control of Imports Acts, 1934 and 1937, and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Control of Imports (Quota No. 31) (Amendment) Order, 1937.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The Control of Imports (Quota No. 31) Order, 1936 (Statutory Rules and Orders, No. 238 of 1936), is hereby amended in the following respects and shall be construed and have effect accordingly, that is to say :—

(a) by the deletion in paragraph 4 of the words " consume not less than twenty watts nor more than five hundred watts and are fitted with a bayonet cap or a screw cap " and the substitution therefor of the words " consume not more than fifteen hundred watts, " and

(b) by the insertion at the end of paragraph 5 of the following word and sub-paragraphs, that is to say :—

" or

(h) which is, in the opinion of the Revenue Commissioners, intended for use exclusively as a sample, or

(i) which at importation forms part of another article imported temporarily, or

(j) which is imported for the personal use of the importer or members of his household in quantities which are, in the opinion of the Revenue Commissioners, reasonable having regard to the circumstances of the case. "

4. This Order shall come into operation on the 26th day of June, 1937.
