No. 240/1937:

WHALE MEASUREMENT REGULATIONS (No. 2), 1937.

WHALE MEASUREMENT REGULATIONS (No. 2), 1937.

WHEREAS it is enacted by sub-section (1) of Section 4 of the Whale Fisheries Act, 1937 (No. 4 of 1937), that the expression " immature whale " means a whale the length of which is less than the prescribed length :

AND WHEREAS it is enacted by sub-section (2) of the said Section that for the purposes of the said sub-section (1) regulations under the said Act may prescribe different lengths for different kinds of whales and may prescribe the manner in which the lengths are to be measured.

AND WHEREAS it is enacted by Section 31 of the said Act that the Minister for Agriculture may by order make regulations in relation to any matter or thing referred to in the said Act as prescribed :

NOW, I, SÉAMAS Ó RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the joint operation of sub-section (2) of Section 4 and Section 31 of the Whale Fisheries Act, 1937 (No. 4 of 1937), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations :—

1.—(1) These regulations may be cited as the Whale Measurement Regulations (No. 2), 1937.

(2) Save as otherwise provided, these regulations shall come into operation on the 1st day of December, 1937.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. For the purposes of Section 4 of the Whale Fisheries Act, 1937 (No. 4 of 1937), the length of whales of each kind mentioned in the second column of the Schedule to these Regulations shall be the length set out in the first column of the said Schedule opposite to such mention in the said second column.

4. The length of any whale measured for the purpose of ascertaining whether such whale is or is not immature within the meaning of Section 4 of the Whale Fisheries Act, 1937 (No. 4 of 1937), shall be measured along a horizontal line and shall be the distance on such line between the tip of the upper jaw and the notch between the flukes of the tail.

5. The Whale Measurement Regulations, 1937 (Statutory Rules and Orders, No. 157 of 1937), are hereby revoked as on and from the date of these Regulations.

70 feet.

Blue whale otherwise known as Sibbald's rorqual or sulphur bottom.

55 feet.

Fin whale otherwise known as common finback, common finner, common rorqual, finback, fin whale, herring whale, razor-back or true fin whale.

35 feet.

Humpback whale otherwise known as bunch, hump-backed whale, hump whale, hunch-backed whale.

35 feet.

Sperm whale otherwise known as spermacet whale, cachalot, or pot whale.
