No. 63/1938: PRICES COMMISSION (PROCEEDINGS) REGULATIONS, 1938. | ||
PRICES COMMISSION (PROCEEDINGS) REGULATIONS, 1938. | ||
WHEREAS it is enacted by sub-section (1) of section 16 of the Control of Prices Act, 1937 (No. 26 of 1937), that the Prices Commission may make regulations for the governance of their proceedings and may by such regulations make provision for all or any of the following matters, that is to say:— | ||
(a) the quorum at any sitting of the Commission; | ||
(b) the times and places of the sittings of the Commission; | ||
(c) the persons to whom notice of the sittings of the Commission shall be given; | ||
(d) the form and manner in which submissions shall be made and evidence given to the Commission, and in particular, whether such submissions and evidence shall be given viva voce or in writing; | ||
(e) the attendance for viva voce or cross-examination of persons who have made submissions or given evidence in writing; | ||
(f) the admission or exclusion of any person to or from the sittings of the Commission; | ||
(g) such matters as appear to the Commission to be necessary or expedient for the proper conduct of their business. | ||
AND WHEREAS it is enacted by sub-section (2) of the said section 16 that such regulations shall not have any force or effect unless and until they have been approved by the Minister for Industry and Commerce. | ||
AND WHEREAS it is enacted by sub-section (3) of the said section 16 that any regulations made under section 17 of the Control of Prices Act, 1932 (No. 33 of 1932), and in force before the commencement of the said Control of Prices Act, 1937 , shall be deemed to have been made under the said section 16 and may be revoked or amended accordingly, and the Prices Commission (Proceedings) Regulations, 1933 ( S.R. & O. No. 69 of 1933 ), were duly made under the said section 17 and were in force before the said commencement. | ||
NOW, THEREFORE, we the Prices Commission in exercise of the powers conferred upon us by section 16 of the Control of Prices Act, 1937 (No. 26 of 1937), and of every and any other power us in this behalf enabling, hereby make the following regulations:— | ||
1. These regulations may be cited for all purposes as the Prices Commission (Proceedings) Regulations, 1938. | ||
2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these regulations. | ||
3. In these regulations:— | ||
the expression "the Act" means the Control of Prices Act, 1937 ; the expression "the Minister" means the Minister for Industry and Commerce; the expression "the Commission" means the Prices Commission established under section 9 of the Act. | ||
4. The quorum at any sitting of the Commission shall be two members of the Commission. | ||
5. (1) The Commission shall sit at such times as the Commission may from time to time determine to be the most suitable for the discharge of their functions under the Act, and the Commission may from time to time adjourn any of the sittings. | ||
(2) The Commission shall sit at such places as the Commission may from time to time determine to be most suitable for the discharge of their functions under the Act. | ||
6. Submissions made to the Commission shall be in writing and shall be forwarded by post to the Secretary to the Commission. | ||
7. Any person shall be admitted to any sitting of the Commission other than any sitting or part of any sitting which the Commission have determined, pursuant to section 19 of the Act, to hold in private. | ||
8. Save as otherwise provided by these regulations the Commission shall determine their practice and procedure. | ||
9. The Prices Commission (Proceedings) Regulations, 1933 ( S.R. & O. No. 69 of 1933 ), are hereby revoked. | ||
