PUBLIC ASSISTANCE (FOOTWEAR REGULATIONS) ORDER, 1944.

FRANCIS CONSTANTINE WARD, Parliamentary Secretary to the Minister for Local Government and Public Health, in exercise of the powers vested in the said Minister by section 5 and sub-section (2) of section 39 of the Public Assistance Act, 1939 , and by virtue of the Local Government and Public Health (Delegation of Ministerial Functions) (No. 2) Order, 1944, and of all other powers in this behalf him enabling by this his Order makes the regulations hereinafter appearing, and orders and declares as follows, that is to say :—

1. This Order may be cited as the Public Assistance (Footwear Regulations) Order, 1944.

2. In this Order—

the expression " official footwear " means boots or shoes manufactured for the purposes of distribution in accordance with this Order by a person approved by the Minister for Supplies ;

the expression " footwear voucher " has the meaning assigned to it in Article 5 of this Order ;

the expression " the Manager " means the person by whom the functions of a public assistance authority other than the reserved functions are performed, and

the expression " retailer " means a person who sells footwear by retail in the ordinary course of his business.

3. All official footwear shall be permanently marked by the manufacturer with the letters C.P. and the retail price to be charged for such footwear, by means of indentation on the soles.

4. A person who is eligible for home assistance by reason of his inability to provide footwear for a child whom he is liable to maintain (other than a child over the age of 16 years or a child resident outside the State or in an institution) may be given such home assistance by the issue of a footwear voucher in accordance with this Order.

5.—(1) A public assistance authority may issue to a person in accordance with this Order a voucher (in this Order referred to as a footwear voucher) entitling such person to obtain official footwear for a specified child whom such person is liable to maintain.

(2) Every footwear voucher shall be signed by the manager of the public assistance authority by whom the same is issued or by an officer of the said public assistance authority authorised in that behalf by such Manager.

6. Every footwear voucher issued under this Order shall be in the form contained in the Schedule to this Order or in a form to the like effect, and shall contain the particulars set out in the said form.

7. Every public assistance authority shall with all convenient speed give public notice by advertising at least once in a newspaper circulating in the functional area of such public assistance authority, that applications for footwear vouchers will be considered from persons unable to provide footwear for children whom they are liable to maintain.

8. Whenever a person to whom a footwear voucher has been issued delivers such voucher to a retailer at his shop when such shop is open for business and within the time limited for presentation of such voucher, such retailer shall give to such person in exchange for such voucher (either out of stock or as soon as such footwear can be procured) official footwear marked with the retail price named in such voucher and suitable for the child named in such voucher, either free of charge or on payment in accordance with the terms of such voucher ; and on receiving such footwear such person shall acknowledge such receipt by his signature on such voucher.

9. A retailer shall, on supplying official footwear in exchange for a footwear voucher, enter on such voucher in the presence of the person to whom the same was issued the date on which such exchange took place.

10.—(1) A retailer who has supplied official footwear in exchange for a footwear voucher in accordance with this Order may within the period mentioned in sub-article 2 of this article present the same to the public assistance authority by whom such voucher was issued together with a demand for the amount of money due by such public assistance authority to such retailer in respect of the official footwear for which such voucher was exchanged.

(2) The period within which a footwear voucher may be presented under sub-article (1) of this Article shall be two months from the date of receipt stated on such voucher, but a public assistance authority may, if it so thinks fit, extend such period in any particular case to a date not later than six months from such date of receipt.

(3) When a retailer who has supplied official footwear in exchange for a footwear voucher in accordance with this Order, presents the same for payment in accordance with the preceding sub-article, the public assistance authority by whom such footwear voucher was issued shall thereupon be deemed to have entered into an agreement to pay to such retailer any money payable on such exchange under the terms of such voucher.

(4) Any money payable by a public assistance authority to a retailer under the preceding sub-article shall, in default of payment, be recoverable as a simple contract debt in any court of competent jurisdiction.

11. Articles 8 to 10 of the Public Assistance (General Regulations) Order, 1942, shall not apply to assistance afforded under this Scheme.

12. Every public assistance authority shall keep accounts of the number of footwear vouchers issued under this Order by such authority and the persons to whom such vouchers are so issued, and such accounts shall show separately the footwear vouchers issued to persons who are not receiving home assistance other than assistance granted under this Order.

This voucher should be presented without delay and not later than one month after the date of issue at the shop of any retailer of boots and shoes. It must be given to the retailer when the footwear is ordered but the receipt on the back should not be signed until the footwear has been received.

Note 4.—"Boots" or "Shoes" should be struck out.

Note 5.—Neither the Notes nor the references to the notes nor the words "alternative 1" etc., should appear on the printed voucher.
