ALLOTMENTS (UNEMPLOYED PERSONS) REGULATIONS, 1945.

The Minister for Local Government and Public Health in exercise of the powers vested in him by section 2 of the Acquisition of Land (Allotments) (Amendment) Act, 1934 , by this his Order makes the following regulations, that is to say :—

1. These regulations may be cited as the Allotments (Unemployed Persons) Regulations, 1945.

2. The Interpretation Act, 1937 , applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In addition to the persons specified in paragraphs (a) and (b) of sub-section (1) of Section 2 of the Acquisition of Land (Allotments) (Amendment) Act, 1934 , any other person who for the time being complies with any of the following conditions shall be an unemployed person for the purposes of that Act, namely :—

(a) that he is in receipt of home assistance or outdoor relief under the enactments relating to the relief of the poor ; or

(b) that he, having been unemployed, is receiving relief from unemployment by being employed on works promoted by the State or a public or local authority primarily as a means of relieving unemployment ; or

(c) that he, at the time of the letting of an allotment to him is unemployed or though employed is without a reasonable prospect of being continuously employed during the ensuing period of six months and that the total period for which he was employed during the twelve months immediately preceding such letting of an allotment to him did not on the average exceed twenty-four hours per week and that his means during such twelve months did not exceed in case he is resident in a county borough or the Borough of Dún Laoghaire sixty-five pounds or in case he is resident elsewhere fifty-two pounds.

4. For the purpose of paragraph (c) of the preceding article, income from a children's allowance under the Children's Allowances Act, 1944 , shall not be reckoned as means.

5. The Allotments (Unemployed Persons) Regulations, 1934 and 1944, are hereby repealed.
