I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) ), and of every and any other power me in this behalf enabling, hereby order as follows :

1. This Order may be cited as the Flour and Bread (Rationing) Order, 1946 (First Amendment) Order, 1947.

2. In this Order, the expression " the Principal Order " means the Flour and Bread (Rationing) Order, 1946 ( S. R. & O. No. 388 of 1946 ).

3. Article 3 of the Principal Order is hereby amended—

(I) by the insertion at the end of the definition of the word " coupon " of the words " or which forms or formed part of a supplementary registration page " ;

(II) by the insertion after the definition of the word " flour " of the following definition :

" the expression ` flour confectionery ' means an article in the manufacture of which sugar, and wheat or any wheaten product are used, but does not include a biscuit or a sweet."

4. Article 5 of the Principal Order is hereby amended by the addition thereto of the following paragraphs :

"(c) the Minister may, at his absolute discretion, issue supplementary registration pages and the supplementary registration pages applicable to a particular ration period shall be those declared by a supplemental order to be the supplemental registration pages applicable to that ration period,

(d) the expression " registration page," when used without qualification, means a registration page of a general ration book, a registration page of a special ration book or a supplementary registration page."

5. Article 6 of the Principal Order is hereby amended—

(I) by the insertion after subparagraph (b) of paragraph (1) of the following subparagraph :

"(bb) any coupon (other than a coupon marked with the word " Cancelled " or the word " Invalid ") which forms part of a supplementary registration page shall be a flour or bread coupon,"

(II) by the addition at the end of subparagraph (c) of paragraph (1) of the words " or forming part of a supplementary registration page issued to such consumer,"

(III) by the insertion in paragraph (2) before the words " shall be valid " of the words " or a supplementary registration page."

6. The following Article shall be inserted after Article 8 of the Principal Order.

"8A. This Order shall not apply in respect of bread which is manufactured specially for persons suffering from diabetes and which is sold by pharmaceutical chemists on the production of a certificate of a registered medical practitioner."

7. Article 12 of the Principal Order is hereby amended by the substitution for the words " or both of the registration pages thereof " of the words " of the registration pages of the general ration book, both of the registration pages of the general ration book, a supplementary registration page issued to the applicant, one only of the registration pages of the general ration book and a supplementary registration page issued to the applicant or both of the registration pages of the general ration book and a supplementary registration page issued to the applicant, being a page or pages."

8. Article 14 of the Principal Order is hereby amended—

(I) by the substitution in paragraph (1) for the words " or both of the registration pages thereof " of the words " of the registration pages of the general ration book, both of the registration pages of the general ration book, a supplementary registration page issued to the applicant, one only of the registration pages of the general ration book and a supplementary registration page issued to the applicant or both of the registration pages of the general ration book and a supplementary registration page issued to the applicant, being a page or pages,"

(II) by the deletion in paragraph (3) of the word " voucher " wherever the word occurs.

9. Article 19 of the Principal Order is hereby amended :

(I) by the insertion in subparagraph (a) of paragraph (1) after the words " special ration book " of the words " or one registration page only of a general ration book or a special ration book and a supplementary registration page,"

(II) by the insertion in subparagraph (b) of paragraph (1) after the words " special ration book " of the words " or a supplementary registration page,"

(III) by the insertion after subparagraph (c) of paragraph (1) of the following subparagraph :

"(d) in case the consumer is registered under this Order as a flour customer with the retailer by the lodgment of three registration pages—three times the flour exchange value of a flour or bread coupon,"

(IV) by the insertion after paragraph (3) of the following paragraph :

" (4) A flour retailer may during a ration week sell to a domestic consumer who is the holder of a general ration book and who is registered under this Order as a flour customer with the retailer by the lodgment of three registration pages, and the consumer may purchase during the ration week from the retailer, a quantity of flour not exceeding twelve times the flour exchange value of a flour or bread coupon during the ration week, and in such case the following provisions shall have effect :

(a) in case the quantity of flour so sold does not exceed six times the flour exchange value of a flour or bread coupon during the ration week—

(i) the retailer shall not sell to the consumer, nor shall the consumer purchase, during the next following ration week any flour,

(ii) the flour or bread coupons of the consumer valid for the next following ration week shall be deemed to be valid for the previous ration week,

(b) in case the quantity of flour so sold exceeds six times, but does not exceed nine times, the flour exchange value of a flour or bread coupon during the ration week—

(i) the retailer shall not sell to the consumer, nor shall the consumer purchase, during the two next following ration weeks any flour,

(ii) the flour or bread coupons of the consumer valid for the said next following ration weeks shall be deemed to be valid for the said previous ration week,

(c) in case the quantity of flour so sold exceeds nine times the flour exchange value of a flour or bread coupon during the ration week—

(i) the retailer shall not sell to the consumer, nor shall the consumer purchase, during the three next following ration weeks any flour,

(ii) the flour or bread coupons of the consumer valid for the said next following ration weeks shall be deemed to be valid for the said previous ration week."

10. Article 20 of the Principal Order is hereby amended—

(I) by the insertion in paragraph (a) after the words " general ration book " of the words " or one registration page only of a general ration book or a special ration book and a supplementary registration page,"

(II) by the insertion in paragraph (b) after the words " special ration book " of the words " or a supplementary registration page,"

(III) by the insertion after paragraph (c) of the following paragraph :

"(d) in case the consumer is registered under this Order as a bread customer with the retailer by the lodgment of three registration pages—three times the bread exchange value of a flour or bread coupon."

11. Article 21 of the Principal Order is hereby amended—

(I) by the deletion of the word " voucher,"

(II) by the substitution in clause (i) of subparagraph (a) of paragraph (1) for the word "consumer," where that word occurs secondly, of the words " registration pages,"

(III) by the insertion after clause (ii) of subparagraph (a) of paragraph (1) of the following clause :

"(iii) in case the consumer is registered under this Order as a flour customer with the retailer by the lodgment of three registration pages—the flour or bread coupons of the registration pages valid for the ration week and, if the retailer has during the ration week supplied any flour to the consumer under paragraph (4) of Article 19 of this Order, every flour or bread coupon of the consumer deemed by that paragraph to be valid for the ration week."

12. Article 22 of the Principal Order is hereby amended—

(I) by the deletion of the word " voucher,"

(II) by the insertion in clause (i) of subparagraph (a) of paragraph (1) before the words " registration pages " of the words " or three " and the substitution in that clause for the word " consumer," where the word occurs secondly, of the words " registration pages

13. Articles 23, 24, 25, 26 and 27 of the Principal Order are hereby amended by the insertion at the end of paragraph (1) of each of those Articles of the words " but every purchase or sale made consequent on any such certificate shall be in conformity with such certificate as completed as aforesaid."

14. Article 28 of the Principal Order is hereby amended by the deletion in paragraph (1) of the words " to which are attached vouchers " and by the insertion in that paragraph of the words " or sale " after the word " purchase."

15. Article 29 of the Principal Order is hereby revoked.

16. Article 31 of the Principal Order is hereby amended—

(I) by the substitution of the following subparagraphs for subparagraphs (a) and (b) of paragraph (1) :

"(a) in case, not being the holder of a supplementary registration page having attached thereto a coupon applicable to the ration week, he converts during the ration week any bread to his own use—any flour in excess of the flour exchange value of a flour or bread coupon,

(b) in case, not being the holder of such supplementary registration page, he does not convert during the ration week any bread to his own use, any flour in excess of twice the flour exchange value of a flour or bread coupon,

(c) in case, being the holder of such supplementary registration page, he converts during the ration week bread to his own use of an amount not greater than the bread exchange value of a flour or bread coupon—any flour in excess of twice the flour exchange value of a flour or bread coupon,

(d) in case, being the holder of such supplementary registration page, he converts during the ration week bread to his own use of an amount greater than the bread exchange value of a flour or bread coupon and not greater than twice the bread exchange value of a flour or bread coupon—any flour in excess of the flour exchange value of a flour or bread coupon,

(e) in case, being the holder of such supplementary registration page, he does not convert during the ration week any bread to his own use—any flour in excess of three times the flour exchange value of a flour or bread coupon."

(II) by the substitution of the following subparagraphs for subparagraphs (a) and (b) of paragraph (2) :

(a) in case, not being the holder of a supplementary registration page having attached thereto a coupon applicable to the ration week, he converts during the ration week any flour to his own use—any bread in excess of the bread exchange value of a flour or bread coupon,

(b) in case, not being the holder of such supplementary registration page, he does not convert during the ration week any flour to his own use, any bread in excess of twice the bread exchange value of a flour or bread coupon,

(c) in case, being the holder of such supplementary registration page, he converts during the ration week flour to his own use of an amount not greater than the flour exchange value of a flour or bread coupon—any bread in excess of twice the bread exchange value of a flour or bread coupon,

(d) in case, being the holder of such supplementary registration page, he converts during the ration week flour to his own use of an amount greater than the flour exchange value of a flour or bread coupon and not greater than twice the flour exchange value of a flour or bread coupon—any bread in excess of the bread exchange value of a flour or bread coupon,

(e) in case, being the holder of such supplementary registration page, he does not convert during the ration week any flour to his own use—any bread in excess of three times the bread exchange value of a flour or bread coupon."

17. The following Articles shall be inserted after Article 36 of the Principal Order :

"37. (1) A person shall not purchase or sell flour or bread unless the transaction is authorised by a permit and is in accordance with the terms of the permit.

(2) Paragraph (1) of this Article shall not apply—

(a) in relation to transactions in which the person purchasing flour or bread is purchasing it as a domestic consumer,

(b) in relation to transactions as respects which provision is made by Part III of this Order.

38.—(1) Any page of a general ration book declared by a supplemental order to be a flour confectionery page shall be for the purposes of this Order a flour confectionery page.

(2) For the purposes of this Order, each coupon forming part of a flour confectionery page shall be a flour confectionery coupon but shall be valid only for the ration week for which it is declared by a supplemental order to be valid.

(3) Notwithstanding anything contained in this Order—

(a) a domestic consumer may purchase flour confectionery from a flour confectionery retailer, and the flour confectionery retailer may sell flour confectionery to the domestic consumer, on the surrender by the domestic consumer to the flour confectionery retailer of a flour confectionery coupon which forms part of a general ration book of which the consumer is the holder, being a coupon which is valid for the ration week in which the purchase is made,

(b) a flour confectionery retailer or wholesaler may purchase flour confectionery from a supplier of flour confectionery, and the supplier of flour confectionery may sell flour confectionery to the flour confectionery retailer or wholesaler, on the surrender by the flour confectionery retailer or wholesaler to the supplier of flour confectionery of a flour confectionery coupon which is valid for the ration week in which the purchase is made or any of the four next preceding weeks.

(4) The quantity of flour confectionery which may be purchased or sold on the surrender under this Article of a flour confectionery coupon shall be a quantity of flour confectionery not exceeding the quantity declared by a supplemental order to be the exchange value of a flour confectionery coupon."
