IMPORTED TIMBER (MAXIMUM PRICES) (No. 13) ORDER, 1949.

IMPORTED TIMBER (MAXIMUM PRICES) (No. 13) ORDER, 1949.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) as amended by the Supplies and Services (Temporary Provisions) Act, 1946 (Continuance) Act, 1947 (No. 39 of 1947)) and of every and any other power me in this behalf enabling hereby order as follows :--

1.--(1) This Order may be cited as the Imported Timber (Maximum Prices) (No. 13) Order, 1949.

(2) This Order shall come into operation on the 1st day of April, 1949.

2.--(1) In this Order--

the expression " the Minister " means the Minister for Industry and Commerce ;

the expression " Dublin Zone " shall mean the area consisting of the county borough of Dublin ;

the expression " Remainder of the State " shall mean the area comprising the whole State excluding the Dublin Zone ;

the expressions " deep cut " and " flat cut " shall have the meanings customarily attached to them in the course of trade in timber.

(2) References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

3.--(1) No person shall sell Canadian Spruce or Swedish or Finnish Whitewood of a kind and description mentioned in Part I of the Schedule hereto at a price in excess of a price calculated at the appropriate rate set out in the third or fourth columns for any width set out in column (2) of the said Part I.

(2) No person shall sell Swedish or Finnish Redwood of a kind and description mentioned in Part I of the Schedule hereto at a price in excess of a price calculated at the appropriate rate set out in the fifth or sixth columns for any width set out in Column (2) of the said Part I.

4. Where Canadian Spruce or Swedish or Finnish Whitewood or Redwood has been deep cut or flat cut after importation the Vendor may add to the appropriate maximum price calculated according to the terms of the preceding paragraphs a charge not exceeding--

(1) in the case of deep cuts a charge calculated at the appropriate rate set out in Column (3) of Part II of the Schedule hereto for any width set out in Column (2) of the said Part II ;

(2) in the case of flat cuts a charge calculated at the rate set out in Column (3) of Part III of the Schedule hereto for the thickness set out in Column (2) of the said Part III.

5. No person shall sell any Canadian Spruce or Swedish or Finnish Whitewood or Redwood unless such timber is so described on every quotation, estimate, invoice or other document used in connection with the sale. Where the timber has been deep cut or flat cut after importation the charges, if any, for such cutting shall be stated in such documents.

6. Where Canadian Spruce or Swedish or Finnish Whitewood or Redwood is sold and is delivered at any place not more than five miles from the vendor's premises, no charge shall be made for the delivery.

7. Where Canadian Spruce or Swedish or Finnish Whitewood or Redwood is sold by a registered timber merchant not being a merchant who obtains his supplies from Timber Importers, Ltd., the appropriate price may be increased by an amount not exceeding the cost of transport at the cheapest rate available borne by such registered timber merchant.

8. Where a direction is given by the Minister in respect of any particular person or group of persons or in respect of any particular Canadian Spruce or Swedish or Finnish Whitewood or Redwood, the provisions of this Order shall, if and in so far as they are inconsistent with such direction, have effect subject to such direction.

9. Where Canadian Spruce or Swedish or Finnish Whitewood or Redwood is sold and the quantity of the timber is 10 cubic feet or less, an addition not exceeding 10 per cent., may be made in calculating the proper maximum price.

10. The Emergency Powers (Timber other than Firewood) (Maximum Prices) Order, 1944 (S. R. & O. No. 5 of 1944), as amended by the Emergency Powers (Timber other than Firewood) (Maximum Prices) Order, 1944 (First Amendment) Order, 1944 (S. R. & O. No. 298 of 1944), and the Emergency Powers (Timber other than Firewood) (Maximum Prices) Order, 1944 (Second Amendment) Order, 1945 (S. R. & O. No. 17 of 1945) shall not apply to Canadian Spruce or Swedish or Finnish Whitewood or Redwood.

11. The Imported Timber (Maximum Prices) (No. 12) Order, 1948 ( S. R. & O. No. 368 of 1948 ) is hereby revoked.
