EMPLOYMENT REGULATION ORDER (BRUSH AND BROOM JOINT LABOUR COMMITTEE), 1952.
|
|
|
WHEREAS the Labour Court (hereinafter called"the Court" ;) pursuant to the provisions of Section 43 of the Industrial Relations Act, 1946 (hereinafter called "the Act") made the Employment Regulation Order (Brush and Broom Joint Labour Committee), 1951 ( S.I. No. 163 of 1951 ), (hereinafter called "the said Order"), fixing the minimum rates of remuneration to be paid generally to and regulating the conditions of employment of workers in relation to whom the Brush and Broom Joint Labour Committee (hereinafter called "the Committee") operates :

|
AND WHEREAS the Committee has also submitted to the Court the proposals set out in the Schedules hereto for fixing the minimum rates of remuneration and for regulating the conditions of employment of workers in relation to whom the Committee operates :
|
|
|
AND WHEREAS the provisions of Section 43 of the Act have been complied with :
|
|
|
NOW THEREFORE, the Court in exercise of the powers conferred on it by Section 43 of the Act hereby orders as follows :--
|
|
|
(1) This Order may be cited as the Employment Regulation Order (Brush and Broom Joint Labour Committee), 1952.
|
|
|
(2) Effect is hereby given to the proposals set out in the Schedules hereto.
|
|
|
(3) The proposals set out in the Schedules hereto shall have effect as from the 24th day of October, 1952, and as from that date the said Order shall be revoked.

GENERAL MINIMUM TIME-RATES FOR MALE WORKERS.

|

|
|
|
SECTION I.--For Male Workers who are employed in one or more of the following operations or branches of work :--
|
 |

" Pan " (Hair and Bass), "Hairs, " " Finishing " (i.e., the work of all wood workers employed in finishing or part finishing brushes or brooms by hand or machine), " Boring " (Hand and Machine 'Boring "), " Drawing," "Bone Brush Cutting," "Bone Brush Fashioning," "Bone Drilling," "Bone Brush Profiling," the manufacture of Artists', Medical, Painting, Whitewash and Tar Brushes or Brooms not otherwise specified ; and
|
|
(a) The drafting, dressing (including cutting), or mixing of animal hair, bass whisk, or other fibre, where the operative performs the aforesaid operations singly or in combination by hand or partly by hand and partly by machine ;
|
|
(b) the working of ivory or celluloid ;
|

GROUND BRUSHES.
|
|
|
Piece-Rates include Grinding and Pointing or Damped and Pointed, but not Finishing. If Unground for Dusters, etc., Piece-Rates include Finishing, Washing Handles, Trimming Flat, and one coat of Varnish or Paint.

Section II.--Overtime Rates for Male and Female Workers employed on Time-Work.
|

|
The Minimum Rates for Overtime in respect of all hours worked by a Worker employed on Time-Work in excess of the declared normal number of hours of work in the trade shall be as follows :--
|
|
|
(a) For the first four hours Overtime in any week, except Sundays and Customary Public and Statutory Holidays, the Overtime Rates shall be Time-and-a-Quarter, that is to say, One-and-a-Quarter times the appropriate Minimum Rate otherwise applicable.
|
|
|
(b) For Overtime after the first four hours of Overtime in any week except Sundays and Customary Public and Statutory Holidays, the Overtime Rate shall be Time-and-a-Half, that is to say, One-and-a-Half times the appropriate Minimum Rate otherwise applicable.
|
|
|
(c) For all time worked on Sundays and Customary Public and Statutory Holidays, the Overtime Rate shall be Double Time, that is to say, Twice the appropriate Minimum Rate otherwise applicable.
|
|
|
Section III.--Overtime Rates for Male and Female Workers Employed on Piece-Work.
|
|
|
The Minimum Rates for Overtime in respect of all hours worked by a worker employed on Piece-Work in excess of the declared normal number of hours of work in the trade shall be as follows:--
|
|
|
(a) For the first Four hours Overtime in any week, except Sundays and Customary Public and Statutory holidays, the overtime Rate shall be :--
|
|
|
(i) For Male Workers the appropriate General Minimum Piece-Rates applicable as specified in Schedule I, Part II of this Order, or, where no General Minimum Piece-Rates have been fixed, Piece-Rates which would yield, in the circumstances of the case, to an Ordinary Worker at least the same amount of money as the General Minimum Time-Rate, with the addition in each case of One-Quarter of the General Minimum Time-Rate which would be applicable to the Worker if he were employed on Time-Work.

|
|
(ii) For Female Workers, the appropriate General Minimum Piece-Rate applicable as fixed, or, where no General, minimum Piece-Rate has been fixed, a Piece-Rate which would yield in the circumstances of the case to an Ordinary Worker, not less, than the appropriate rate per hour as shown in Part IV, Schedule I, of this Order, with an addition of One-Quarter in each case per hour.

|
(b) For Overtime after the first four hours of Overtime in any week, except Sundays and Customary Public and Statutory Holidays, the Overtime Rates shall be:--
|
|
|
(i) For Male Workers the appropriate General Minimum Piece-Rate applicable as fixed, or, where no such General Minimum Piece-Rate has been fixed, a Piece-Rate which would yield in the circumstances of the case, to an Ordinary Worker, at least the same amount of money as the appropriate General Minimum Time-Rate, with the addition in each case of One-Half of the appropriate General Minimum Time-Rate which would be applicable to the worker if he were employed on Time-Work.

PART III.
|
|
|
NORMAL WORKING HOURS AND OVERTIME RATES.
|
|
|
Section I.--The normal hours of work to be worked by workers in relation to whom the Committee operates shall be as follows :--

Provided that all hours worked on Sunday and on Customary Public and Statutory Holidays shall be regarded as Overtime to which the Overtime Rates shall apply.
|
|
|
Section II.--The Minimum Rates for Overtime in respect of all hours worked by a Worker, whether employed on Time-Work or on Piece-Work, in excess of the declared normal number of hours of work in the trade, shall be as follows :--
|
|
|
(a) For the first four hours Overtime in any week, except on Sundays and Customary Public and Statutory Holidays, the Overtime Rates shall be Time-and-a-Quarter, that is to say, One-and-a-Quarter times the appropriate Minimum Rate otherwise applicable.
|
|
|
(b) For Overtime after the first four hours of Overtime in any week except on Sunday and Customary Public and Statutory Holidays, the Overtime Rate shall be Time-and-a-Half, that is to say One-and-a-Half times the appropriate Minimum Rate otherwise applicable.
|
|
|
(c) For all time worked on Sunday and Customary Public and Statutory Holidays, the Overtime Rate shall be Double Time, that is to say, Twice the appropriate Minimum Rate otherwise applicable.
|

SCHEDULE III.
|
|
|
DEFINITION OF WORKERS.
|
|
|
The minimum rates of wages and conditions of employment, specified in Schedules I and II shall apply, subject to the provisions of the Industrial Relations Act, 1946 , to all workers, in respect of any time during which they are employed in any branch of the Trade specified in the Trade Boards (Brush and Broom) Order, 1919, that is to say :--
|

The manufacture of brushes (other than feather brushes) or brooms, Including the following operations, where all or any of them are carried on in association with or in conjunction with the manufacture of such brushes or brooms :
|
|
|
(a) The drafting, dressing or mixing of bass, whisk, or similar fibres or animal bristles or hair, and the working of wood, bone, ivory or celluloid ;
|
|
|
(b) All finishing, warehousing, packing or other operations incidental to or appertaining to the manufacture of such brushes or brooms ;
|
|
|
but Excluding the following operations :--
|
|
|
The sawing and turning of wood as a preliminary operation to the manufacture of such brushes or brooms ; the making of metal parts and the mounting of brushes with metal or tortoiseshell backs.
