FOREIGN BIRTHS REGULATIONS, 1956. |

The Minister for External Affairs in exercise of the powers conferred on him by subsection (5) of section 27 of the Irish Nationality and Citizenship Act, 1956 (No. 26 of 1956), hereby, with the consent, in so far as these Regulations relate to fees, of the Minister for Finance, makes the following Regulations : |

PART I. PRELIMINARY AND GENERAL. |
|||||||||||||||||||||||
1. These Regulations may be cited as the Foreign Births Regulations, 1956. |
|||||||||||||||||||||||
2. In these Regulations-- |
|||||||||||||||||||||||
" the Act " means the Irish Nationality and Citizenship Act, 1956 (No. 26 of 1956) ; |
|||||||||||||||||||||||
" the Minister " means the Minister for External Affairs. |
|||||||||||||||||||||||
3.--(1) Every foreign births entry book shall be in the form set out in the First Schedule hereto. |
|||||||||||||||||||||||
(2) The foreign births entry book shall be kept, in the case of a diplomatic mission, by the head of the mission, and, in the case of a consular office, by the head of the office. |
|||||||||||||||||||||||
(3) The foreign births register shall be in the form set out in the Second Schedule hereto. |
|||||||||||||||||||||||
(4) The foreign births register shall be kept in the Department of External Affairs in Dublin by the Secretary of that Department. |
|||||||||||||||||||||||
4.--(1) The birth of a person whose birth is registrable under subsection (2) of section 27 of the act may be registered either in a foreign births entry book or in the foreign births register at the option of the person registering the birth. |
|||||||||||||||||||||||
(2) An entry in pursuance of paragraph (1) of this Article shall be made-- |
|||||||||||||||||||||||
(a) in the foreign births entry book by, in the case of a diplomatic mission, the head of the mission or other officer duly authorised by him in that behalf or, in the case of a consular office, the head of the office or other officer duly authorised by him in that behalf, and |
|||||||||||||||||||||||
(b) in the foreign births register by the Secretary of the Department of External Affairs or other officer of the Minister duly authorised by him in that behalf. |
|||||||||||||||||||||||
(3) An entry in pursuance of paragraph (1) of this Article shall not be made save at the request of the person whose birth is registrable or, where such person is not of full age, of either parent of that person or of any person present at the birth of or having charge of that person and on production of such evidence as may be required. |
|||||||||||||||||||||||
5. Every person authorised by or under these Regulations to make entries of births or persons in a foreign births entry book or in the foreign births register shall, after entering in the book or register, in respect of a birth, the particulars required by these Regulations to be entered therein, sign the book or register at the appropriate place. |

PART II. FOREIGN BIRTHS ENTRY BOOK. |

6. The particulars to be entered in a foreign births entry book in respect of every birth registered therein shall be the particulars specified at the head of the respective columns of the form of foreign births entry book set out in the First Schedule hereto. |
|||||||||||||||||||||||
7. The fee to be charged for registration in a foreign births entry book shall be two pounds. |
|||||||||||||||||||||||
8. Any person may, on payment of a fee of five shillings, inspect at any diplomatic mission or consular office during the hours at which the mission or office is open for the transaction of business the foreign births entry book kept therein. |

9.--(1) Any person may obtain a copy of an entry in a foreign births entry book on payment of a fee of five shillings. |
|||||||||||||||||||||||
(2) Every such copy of an entry in a foreign births entry book shall be authenticated by being certified to be a true copy of the entry by a person authorised by or under these Regulations to make entries of births in the diplomatic mission or consular office, as the case may be, in which the book is kept. |
|||||||||||||||||||||||
10. Copies in triplicate of all entries made in each month in the foreign births entry book kept at a diplomatic mission or consular office shall, at the end of that month, be transmitted to the Department of External Affairs by, in the case of a diplomatic mission, the head of the mission and, in the case of a consular office, the head of the office. |

PART III. FOREIGN BIRTHS REGISTER. |
|||||||||||||||||||||||
11. The particulars to be entered in the foreign births register in respect of every birth registered therein shall be the particulars specified at the head of the respective columns of the form of foreign births register set out in the Second Schedule hereto. |
|||||||||||||||||||||||
12. The fee to be charged for registration in the foreign births register shall be two pounds. |
|||||||||||||||||||||||
13. Every birth which is registered in a foreign births entry book and a copy of the entry of which in the book is transmitted to the Department of External Affairs under these Regulations shall be entered in the foreign births register by a person authorised by or under these Regulations to make entries of births in the register. |
|||||||||||||||||||||||
14. Where an entry is made in the foreign births register in pursuance of Article 13 of these Regulations, the following additional particulars shall be entered in respect of the entry : |
|||||||||||||||||||||||
(a) the number of the foreign births entry book in which the original entry was made ; |
|||||||||||||||||||||||
(b) the number and date of the entry in the foreign births entry book, and |
|||||||||||||||||||||||
(c) the diplomatic mission or consular office at which the foreign births entry book is kept. |
|||||||||||||||||||||||
15. Any person may, on payment of a fee of five shillings, inspect the foreign births register at the Department of External Affairs during the hours when the Department is open for the transaction of business. |
|||||||||||||||||||||||
16.--(1) Any person may obtain a copy of an entry in the foreign births register on payment of a fee of five shillings. |

EXPLANATORY NOTE. |
|||||||||||||||||||||||
Section 7 (2) (a) of the Irish Nationality and Citizenship Act, 1956 (No. 26 of 1956) provides that a person born outside Ireland shall not be an Irish citizen, if the father or mother through whom he derives citizenship was also born outside Ireland, unless that person's birth is registered under section 27 of the act. The foregoing Regulations govern the registration of such births and are made by the Minister for External Affairs in accordance with the powers conferred on him n that regard by section 27 (5) of the Act. |
