SOCIAL WELFARE (DISABILITY, UNEMPLOYMENT AND MARRIAGE BENEFIT) (AMENDMENT) (No. 2) REGULATIONS, 1956.

SOCIAL WELFARE (DISABILITY, UNEMPLOYMENT AND MARRIAGE BENEFIT) (AMENDMENT) (No. 2) REGULATIONS, 1956.

I, BRENDAN CORISH, Minister for Social Welfare, in exercise of the powers conferred on me by sections 3 and 28 of the Social Welfare Act, 1952 (No. 11 of 1952), and with the sanction of the Minister for Finance, hereby make the following regulations :--

1.--(1) These Regulations may be cited as the Social Welfare (Disability, Unemployment and Marriage Benefit) (Amendment) (No. 2) Regulations, 1956.

(2) The Social Welfare (Disability, Unemployment and Marriage Benefit) Regulations, 1953 ( S.I. No. 7 of 1953 ), (hereinafter referred to as " the Principal Regulations "), the Social Welfare (Disability, Unemployment and Marriage Benefit) (Amendment) Regulations, 1956 ( S.I. No. 157 of 1956 ) and these Regulations shall be construed as one and may be cited collectively as the Social Welfare (Disability, Unemployment and Marriage Benefit) Regulations, 1953 to 1956.

2. These Regulations shall come into operation on the 3rd day of September, 1956.

Sub-article (5) of article 4 of the Principal Regulations is hereby amended by the insertion after the words " benefit year " of the words " (including a benefit year regarded as continuing by virtue of the provisions of paragraph 1A of the Fourth Schedule to the Act, being the paragraph inserted in that Schedule by article 3 of the Social Welfare (Modification of Contribution Conditions for Benefit) Regulations, 1956 ( S.I. No. 156 of 1956 )) ".

4. Sub-article (2) of article 5 of the Principal Regulations is hereby amended by the insertion of the words " respect of " after the words " paid or credited in ".

5. The First Schedule to the Principal Regulations, being the Schedule inserted by article 4 of the Social Welfare (Disability, Unemployment and Marriage Benefit) (Amendment) Regulations, 1956, is hereby deleted and the following substituted therefor--

EXPLANATORY NOTE.

The Principal Regulations, i.e. the Social Welfare (Disability, Unemployment and Marriage Benefit) Regulations, 1953 ( S.I. No. 7 of 1953 ) provide, inter alia, for the payment, in accordance with the First Schedule to the Regulations, of reduced rates of disability and unemployment benefit where the contribution conditions during the governing contribution year are only partially satisfied, subject to a minimum of 26 contributions paid or credited.

Consequent on the increase in the maximum rates of benefit as provided for in the Social Welfare (Amendment) Act, 1956 (No. 24 of 1956) the reduced rates of benefit payable where the contribution conditions are only partially satisfied are increased by these Regulations.
