I, GERARD SWEETMAN, Minister for Finance, on the representation of the Minister for Posts and Telegraphs as testified by his Official Seal affixed hereto and in exercise of the powers conferred on me by sections 14 and 82 of the Post Office Act, 1908, hereby order as follows :-- |
||||||||||
1. (1) This Warrant may be cited as the Newspapers (Special Service for Conveyance by Post Office Mail Vans) Warrant, 1957. |
||||||||||
(2) This Warrant shall come into operation on the 14th day of March, 1957. |
||||||||||
2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Warrant. |
||||||||||
3. In this Warrant-- |
||||||||||
" the Minister " means the Minister for Posts and Telegraphs ; |
||||||||||
" the Special Newspaper Service " means the service authorised by the Minister, with the consent of the Minister for Finance, pursuant to the Post Office Act, 1908, for the conveyance of newly published daily newspapers on Post Office mail vans on such rural services as may be approved from time to time by the Minister. |
||||||||||
4. Newspapers for conveyance by the Special Newspaper Service shall be made up in bundles (in this Warrant referred to as newspaper bundles) and each such bundle shall fulfil the following requirements : |
||||||||||
(a) the bundle shall comprise two or more daily newspapers fastened together by a wrapper or string and shall bear the name and address of a news agent, |
||||||||||
(b) the bundle shall not exceed 15 lb. in weight, |
||||||||||
(c) the newspapers comprised in the bundle shall have been published by the same publisher on the day on which they are tendered for conveyance by the Special Newspaper Service. |
||||||||||
5. A newspaper bundle for conveyance by the Special Newspaper Service shall be tendered at a Post Office starting point of the mail motor vans at least ten minutes before the time of departure of such vans. |
||||||||||
6. Delivery and taking of delivery of a newspaper bundle conveyed by the Special Newspaper Service shall be outside the post office nearest to the address of the addressee unless the addressee requests that delivery and taking delivery shall be outside another post office on the route of the mail motor van, but the mail motor van shall not be required to deviate from its customary route as fixed by the Minister. |

7. (1) The sums to be charged in respect of newspaper bundles conveyed by the Special Newspaper Service to a news agent shall be the annual sums specified in the Schedule to this Warrant. |
||||||||||
(2) Payment of the said sums shall be made half-yearly in arrear. |
||||||||||
(3) Liability for payment of the said sums shall commence and shall be reckoned as from the first day of the month next after the conveyance to the news agent starts, but in a case in which conveyance starts on the first day of a month, liability for payment shall commence and be reckoned as from that day. |
||||||||||
(4) Liability for payment of the said sums for conveyance by the Special Newspaper Service during any month shall continue until and shall be reckoned for payment to the end of that month. |
||||||||||
8. (1) Lists shall be furnished to the Minister in the month of January and in the month of July in each year by each publisher using the Special Newspaper Service. |
||||||||||
(2) The lists furnished as aforesaid by a publisher shall contain-- |
||||||||||
(a) the name and address of each news agent for each local head post office area to whom newspaper bundles are being conveyed by the Special Newspaper Service, |
||||||||||
(b) the total number of newspaper bundles to be conveyed classified in accordance with the categories of weights specified in the Schedule to the Warrant, and |
||||||||||
(c) any further information which the Minister may require by notice in writing. |
||||||||||
9. At least two days notice of intention to send or to cease to send newspaper bundles by the Special Newspaper Service shall be given by the publisher to the Minister. |
||||||||||
10. The Minister shall not be liable for any loss, damage, delay, non-delivery or misdelivery of any newspaper bundles sent by the Special Newspaper Service. |
||||||||||
11. Any mail car contractor or mail boat contractor who-- |
||||||||||
(a) has entered into a contract with the Minister for the conveyance of mails, and |
||||||||||
(b) is authorised in writing by the Minister so to do, may collect, convey and deliver newspaper bundles and may charge therefor and no postage or other charge shall be payable to the Minister in respect thereof. |

EXPLANATORY NOTE. |
||||||||||
This instrument authorises the conveyance of bundles of newly published daily newspapers by Post Office mail vans on rural services and fixes the scales of charges therefor. |
||||||||||
