PENSIONS (INCREASE) (DUBLIN PORT AND DOCKS BOARD) REGULATIONS, 1957.

PENSIONS (INCREASE) (DUBLIN PORT AND DOCKS BOARD) REGULATIONS, 1957.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 6 of the Pensions (Increase) Act, 1956 (No. 44 of 1956), hereby make the following regulations :

1. These Regulations may be cited as the Pensions (Increase) (Dublin Port and Docks Board) Regulations, 1957.

2. In these Regulations--

" the Act " means the Pensions (Increase) Act, 1956 (No. 44 of 1956) ;

" the appropriate sum " has the meaning given to it in the Act ;

" the harbour authority " means the Dublin Port and Docks Board ;

" pension " means a pension or allowance specified in Part IV of the Schedule to the Act ;

" officer " and " servant " mean, respectively, subject to any decision of the Minister under subsection (5) of Section 38 of the Harbours Act, 1946 (No. 9 of 1946), a person deemed by the harbour authority to have served as an officer or as a servant of the authority.

3. The increase in pension which may be granted by the harbour authority under the Act in the case of an officer shall not exceed whichever of the following is the less--

(a) the appropriate sum, or

(b) the amount which would bring the pension up to that which would be payable to an officer of equivalent status and service who retired on the 31st day of May, 1953.

4. The increase in pension which may be granted by the harbour authority under the Act in the case of a servant shall not exceed whichever of the following is the less--

(a) the appropriate sum, or

(b) the amount which would bring the pension up to that which would be payable to a servant assuming him to be of equivalent status and service and the date of his retirement to be the 28th day of February, 1953.

EXPLANATORY NOTE.

These Regulations authorise the Dublin Port and Docks Board to increase certain superannuation allowances payable by them.
