I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and after due compliance with section 106 of that Act, hereby order as follows :--

1.--(1) This Order may be cited as the Harbour Rates (Galway Harbour), Order 1947 (Amendment) Order, 1957.

(2) This Order shall come into operation on the 16th day of September, 1957.

2.--(1) The rates set out in the Schedule to this Order are hereby fixed as the maximum rates to be charged on the commodities specified in that Schedule by the Galway Harbour Commissioners in respect of Galway Harbour.

(2) The Harbour Rates (Galway Harbour) Order, 1947 ( S. R. & O. No. 162 of 1947 ), in so far as it operates to fix the maximum rates to be charged in respect of any commodity specified in the Schedule to this Order, shall cease to have effect.

(3) Where the rates fixed under this Article are payable at a tonnage charge, lesser weights shall be chargeable as follows :--

(a) any weight not exceeding 5 cwt. shall count as 5 cwt.

(b) any weight over 5 cwt. to 10 cwt. shall count as 10 cwt.

(c) any weight over 10 cwt. to 15 cwt. shall count as 15 cwt.

(d) any weight over 15 cwt. to 20 cwt. shall count as a ton.

3. The Harbour Rates (Galway Harbour) Order, 1947, as amended by Article 2 of this Order, shall have effect as if--

(1) the import rates set out in the First Schedule were increased by ten per cent.

(2) the rate specified at reference number 1(b) in the Second Schedule were increased to two shillings and threepence ;

(3) the following were substituted for the matter contained at reference number 1(c) in the Second Schedule :

" (c)

On every ton of the net register tonnage or of half the gross tonnage, whichever is the greater, of every vessel entering the harbour and not shipping, unshipping or transhipping any cargo or passengers other than provisions or fuel to be used for the purpose of the voyage--

(i) if entering the harbour from any port or place in the State, Northern Ireland or Great Britain, a sum not exceeding

(ii) if entering the harbour from any port or place other than a port or place in the State, Northern Ireland or Great Britain, a sum not exceeding

(4) the following were substituted for the matter contained at reference number 3 in the Second Schedule :

" 3

Tonnage rates on Vessels other than Vessels described at reference numbers 1, 2 and 4 in this Schedule.

(a)

On every vessel in whatever way propelled including yachts, sailing boats, motor boats and rowing boats, and including such vessels plying for hire, using or lying alongside any dock, wharf or pier at the harbour, as a composition in full of tonnage rates payable on the 1st day of May, an annual sum not exceeding--

(b)

On every vessel to which this reference number relates which has not paid in advance the composition rate, for each entry into the harbour, a sum not exceeding--

(5) the rate specified at reference number 4 in the Fourth Schedule were increased to two pounds and fifteen shillings ; and

(6) the rate specified at reference number 5 in the Fourth Schedule were increased to one pound.

Explanatory Note.
