GREYHOUND INDUSTRY ACT, 1958. GREYHOUND RACE TRACK (PERMITS FOR PERSONS PERFORMING SPECIFIED FUNCTIONS) REGULATIONS, 1959.

Bord na gCon, in exercise of the powers conferred on it by Section 25 of the Greyhound Industry Act, 1958 (No. 12 of 1958,) and also by subsection (3) of Section 5 of the said Act hereby makes the following regulations, that is to say :--

Definitions.

1. In these regulations the following words and expressions have the meanings hereby assigned to them, that is to say :--

"the Act" means the Greyhound Industry Act, 1958 (No. 12 of 1958) ;

"greyhound race track" means a greyhound race track licensed by the Board under the Act on which greyhound races are held for reward ;

"authorised officer" means a person appointed in writing by the Board to be an authorised officer for the purposes of the Act.

Specified classes of functions.

2. It shall not be lawful for any person to carry out any of the functions, hereinafter referred to as specified functions, of racing-manager, handicapper, judge, control steward, timekeeper or hare-driver on greyhound race tracks save under and in accordance with a permit granted by the Board at its discretion.

Applications for permits.

3.--(i) A person who proposes to perform any of the functions specified in Article 2 of these regulations and who is not disqualified from doing so under sub-paragraph (ii) of this Article shall make application to the Board for the grant or the renewal (as the case may be) of a permit and the application shall be made in such form or manner as the Board may direct and shall be accompanied by the appropriate fee as prescribed in Article 6 of these Regulations. In the event of an application for the grant or renewal of a permit being refused the Board shall refund the fee paid on foot of such application.

(ii) A person shall be disqualified from performing any specified functions if he has been convicted of an offence under the Act or if an exclusion order made under the Act applied or applies to him.

Conditions attaching to permits.

4.--(i) It shall be a condition of any permit granted under these regulations that the holder of such permit shall not have any beneficial interest in the ownership of any greyhound raced on any greyhound race track.

(ii) It shall be a condition of any permit granted under these regulations that the holder of such permit shall not engage in betting on greyhound races held at any greyhound race track.

(iii) It shall be a condition of any permit granted under these regulations that the holder of such permit shall not have any beneficial interest on bookmaking in any greyhound race track.

(iv) Without prejudice to the conditions prescribed in the foregoing sub-paragraphs of this Article, the Board may, on the grant or renewal of a permit under these regulations, attach such other conditions as it thinks fit to the permit.

Grant of permits.

5.--(i) (The Board may grant or refuse to grant an application for a permit or for the renewal of a permit under these regulations.

(ii) The Board may at any time suspend for such time as it thinks fit or revoke any permit granted under these regulations.

(iii) A permit granted by the Board under these regulations shall not be transferable to any other person and shall be valid until 31st December next following the date of issue unless previously suspended or revoked.

Charges for permits.

6. The charges payable to the Board for the grant and renewal of permits shall be as follows :--

Production of permits on demand.

7. The holder of a permit granted under these regulations shall keep and have in his possession such permit when performing any specified functions at a greyhound race track and shall produce such permit for inspection at all reasonable times on the demand of an authorised officer of the Board (subject to production by such officer if so required of his appointment).

Revocation and surrender of permits.

8.--(i) Where a person who is the holder of a permit granted under these regulations ceases to be a person performing any specified functions at a greyhound race track such permit shall be deemed, by virtue of this Article, to have been revoked upon such cesser and shall be surrendered to the Board.

(ii) Where a person who is the holder of a permit granted under these regulations is convicted of an offence under the Act or where an exclusion order made under the Act applies to him his permit shall thereupon be deemed to have been revoked.

Citation and commencement.

9.--(i) These regulations may be cited as the Greyhound Race Track (Permits for Persons performing Specified Functions) Regulations, 1959.

(ii) These regulations shall come into operation on the First day of February, 1959.

EXPLANATORY NOTE

The effect of these Regulations is that from 1st February, 1959, persons performing the functions of racing manager, handicapper, judge, control steward, timekeeper or hare-driver on greyhound race tracks must hold permits from Bord na gCon.
