HEALTH (AGE LIMIT FOR OFFICE OF DISTRICT MEDICAL OFFICER) DECLARATION, 1960.

The Minister for Heath, being the appropriate Minister for the purposes of Part II of the Local Government Act, 1941 (No. 23 of 1941), in relation to the offices to which this Declaration applies, in exercise of the powers conferred on him by section 13 of the Local Government Act, 1941 , as adapted by the Health (Transfer of Departmental Administration and Ministerial Functions) Order, 1947 (S.R. and O. 1947, No. 58) and section 23 of the said Act as so adapted and as amended by section 24 of the Local Government Act, 1955 (No. 9 of 1955), hereby declares as follows:--

1. This Declaration may be cited as the Health (Age Limit for Office of District Medical Officer) Declaration, 1960.

2. Subject to the provisions of paragraph (b) of subsection (5) of section 23 of the Local Government Act, 1941 (which subsection was inserted by section 24 of the Local Government Act, 1955 )--

(a) the age limit for--

(i) the office of district medical officer for a dispensary district included in the first column of Part I of the Schedule to this Declaration, and,

(ii) an office of district medical officer specified in the first column of Part II of the said Schedule,

shall be the age specified opposite to the reference to such dispensary district or office in the second column of the said Schedule, and

(b) the age limit for each other office of district medical officer shall be seventy years.

3. The Health (Officers Age Limit) Declaration, 1960 ( S.I. No. 1 of 1960 ) is hereby revoked insofar as it applies to the office of district medical officer.

EXPLANATORY NOTE.

A general upper age limit of seventy years, operative from 1st July, 1960, was prescribed for district medical officers by the Health (Officers Age Limit) Declaration, 1960 ( S.I. No. 1 of 1960 ). This Declaration, insofar as it would have applied to district medical officers, is being revoked by the above Declaration. The new Declaration will, in the case of any office of district medical officer the present holder of which will be aged over sixty-seven on 1st August, 1960, prescribe a new age limit of seventy-two years. The limits for offices, the present holders of which will, on 1st August, 1960, be within approximately two years of reaching the age of sixty-seven, are also changed, so that such an officer will not have to retire significantly earlier than a person aged sixty-seven on 1st August, 1960. For all other offices of district medical officer, the age-limit of seventy years is being re-imposed, but, in accordance with section 23 (2) of the Local Government Act, 1941 , it will have effect only from 1st January, 1961.
