The Minister for Health, in exercise of the powers conferred on him by subsection (3) of section 25 of the Health Authorities Act, 1960 (No. 9 of 1960) hereby makes the following Regulations :-- |
||
1. These Regulations may be cited as the Health Authorities Act, 1960 (Wicklow Mental Hospital District) Regulations, 1964. |
||
2. On the 1st day of April, 1964-- |
||
(a) Section 11 of the Health Authorities Act, 1960 , shall cease to have effect in relation to the Council of the County of Wicklow; |
||
(b) The agreement made between the Dublin Corporation, the Dun Laoghaire Corporation and the Councils of the Counties of Dublin and Wicklow in pursuance of paragraph (b) of subsection (1) of section 11 of the Health Authorities Act, 1960 , shall be modified by the deletion therefrom of the Council of the County of Wicklow. |

3. The Council of the County of Wicklow and Dublin Health Authority shall make such financial adjustment in respect of expenditure for the local financial year ending on the 31st day of March, 1964, or any earlier local financial year as those authorities may agree upon or failing such agreement as may be determined by a person appointed for that purpose by the Minister for Health. |

4. Until the Council of the County of Wicklow have provided a district mental hospital for the Wicklow Mental Hospital District, patients from the said district shall, on and after the 1st day of April, 1964, be received and maintained in the district mental hospital of the Dublin Health Authority in pursuance of an arrangement to be made between the said authorities under subsection (3) of section 10 of the Health Act, 1953 (No. 26 of 1953) and the Council of the County of Wicklow shall pay the Dublin Health Authority for such patients such sum as may be agreed upon between the said authorities or in default of agreement as may be determined by the Minister for Health. |

5. The property and liabilities of the Dublin Health Authority relating to the provision of services under the Mental Treatment Acts, 1945 to 1961, shall be retained by the said authority and in consideration of such retention the said authority shall pay to the Council of the County of Wicklow the sum of £100,000 in one sum or by such instalments as may be agreed upon between the said authorities or in default of agreement as may be determined by the Minister for Health. |

EXPLANATORY NOTE. |
||
These Regulations make modifications in section 11 of the Health Authorities Act, 1960 , and in an agreement made under that section between Dublin Corporation, Dún Laoghaire Corporation. Dublin County Council and Wicklow County Council. These modifications are necessary because of the vesting as from 1st April, 1964, in Wicklow County Council of the duty to provide services under the Mental Treatment Acts, 1945 to 1961. The Regulations also contain consequential financial provisions. |
