MARITIME JURISDICTION (AMENDMENT) ACT, 1964 (SPECIFIED STATES) ORDER, 1965.

MARITIME JURISDICTION (AMENDMENT) ACT, 1964 (SPECIFIED STATES) ORDER, 1965.

The Government, in exercise of the power conferred on them by section 3 of the Maritime Jurisdiction (Amendment) Act, 1964 (No. 32 of 1964), hereby order as follows:

1. This Order may be cited as the Maritime Jurisdiction (Amendment) Act, 1964 (Specified States) Order, 1965.

2. In this Order--

"demersal species" means any species of sea fish which lives most of its adult life at or near the sea bottom and includes in particular brill, cod, conger eel, haddock, hake, halibut, ling, plaice, ray, skate, sole, turbot and whiting;

"the section" means section 3 of the Maritime Jurisdiction (Amendment) Act, 1964 (No. 32 of 1964).

3.--(1) As respects that portion of the exclusive fishery limits of the State mentioned in subsection (1) of the section, the states the fishing vessels of which, subject to paragraph (1) of Article 4 of this Order, may fish therein shall be the states specified in Part I of the Schedule to this Order.

(2) As respects that portion of the exclusive fishery limits of the State mentioned in subsection (2) of the section, the states the fishing vessels of which, for the periods mentioned in the said subsection (2) and subject to paragraph (2) of Article 4 of this Order, may fish therein shall be the states specified in the said Part I.

4.--(1) Fishing in that portion of the exclusive fishery limits of the State mentioned in subsection (1) of the section by a vessel which is a vessel specified in the first column of Part II of the Schedule to this Order is hereby confined to--

(a) the stocks of fish specified in the second column of the said Part II, and

(b) the fishing grounds in that part of the exclusive fishery limits of the State mentioned in subsection (1) of the section which lie within a portion of the exclusive fishery limits of the State specified in the third column of the said Part II,

opposite the mention of the vessel.

(2) Fishing in that portion of the exclusive fishery limits of the State mentioned in subsection (2) of the section by a vessel which is a vessel specified in the first column of the said Part II is hereby confined to--

(a) the stocks of fish specified in the second column of the said Part II, and

(b) the fishing grounds in that part of the fishery limits of the State mentioned in subsection (2) of the section which lie within a portion of the exclusive fishery limits of the State specified in the third column of the said Part II,

opposite the mention of the vessel.

Belgian fishing vessels.

Demersal species, herring and nephrops in the fishing grounds to which fishing by the vessels specified opposite is by this Order confined.

The portions of the exclusive fishery limits of the State which lie;

(a) directly opposite that part of the baseline which passing through Slyne Head joins Carrickakin, Achill Island to Kerry Head,

(b) directly opposite that part of the baseline which passing through the Stags, Toe Head, joins the Great Foze Rock to Carnsore Point, and

(c) directly opposite that part of the baseline which passing through Howth Head joins Wicklow Head to Ballagan Point, County Louth.

British fishing vessels.

Demersal species in the fishing grounds in either portion of the exclusive fishery limits of the State specified opposite which are fishing grounds to which fishing by the vessels so specified is by this Order confined.

The portions of the exclusive fishery limits of the State which lie;

(a) due north of the mouth of Lough Foyle, and

(b) directly opposite that part of the baseline which passing through Carrickakin, Achill Island joins Inishowen Head to Galley Head.

Demersal species, herring and mackerel in the fishing grounds in the portion of the exclusive fishery limits of the State specified opposite which are fishing grounds to which fishing by the vessels specified opposite is by this Order confined.

The portion of the exclusive fishing limits of the State which lies directly opposite that part of the baseline which passing through the Old Head of Kinsale joins Galley Head to Hook Head.

Demersal species, herring, mackerel, nephrops and escallops in the fishing grounds in either portion of the exclusive fishery limits of the State specified opposite which are fishing grounds to which fishing by the vessels so specified is by this Order confined.

The portions of the exclusive fishery limits of the State which lie;

(a) directly opposite that part of the baseline which passing through Carnsore Point joins Hook Head to Ballagan Point, County Louth, and

(b) east of the mouth of Carlingford Lough.

Fresh fishing vessels.

Demersal species and nephrops in the fishing grounds in the portion of the exclusive fishery limits of the State specified opposite which are fishing grounds to which fishing by the vessels so specified is by this Order confined.

The portion of the exclusive fishery limits of the State which lies directly opposite that part of the baseline which passing through Carrickakin, Achill Island joins Malinmore Head to Sybil Point.

Demersal species, nephrops and mackerel in the fishing grounds in the portion of the exclusive fishery limits of the State specified opposite which are fishing grounds to which fishing by the vessels so specified is by this Order confined.

The portion of the exclusive fishery limits of the State which lies directly opposite that part of the baseline which passing through the Great Foze Rock joins Sybil Point to The Stags, Toe Head.

Demersal species, nephrops herring and mackerel in the fishing grounds in the portion of the exclusive fishery limits of the State specified opposite which are fishing grounds to which fishing by the vessels so specified is by this Order confined.

The portion of the exclusive fishery limits of the State which lies directly opposite that part of the baseline which passing through the Old Head of Kinsale joins The Stags, Toe Head to Carnsore Point.

Demersal species in the fishing grounds in the portion of the exclusive fishery limits of the State specified opposite which are fishing grounds to which fishing by the vessels so specified is by this Order confined.

The portion of the exclusive fishery limits of the State which lies directly opposite that part of the baseline which passing through Howth Head joins Carnsore Point to Ballagan Point, County Louth.

German fishing vessels.

Herring in the fishing grounds to which fishing by the vessels specified opposite is by this Order confined.

The portion of the exclusive fishery limits of the State which lies directly opposite that part of the baseline which passing through Hook Head joins the Old Head of Kinsale to Carnsore Point.

Netherlands fishing vessels.

Herring and mackerel in the fishing grounds to which fishing by the vessels specified opposite is by this Order confined.

The portion of the exclusive fishery limits of the State which lies directly opposite that part of the baseline which passing through the Old Head of Kinsale joins The Stags, Toe Head to Carnsore Point.

Spanish fishing vessels.

Demersal species in the fishing grounds to which fishing by the vessels specified opposite is by this Order confined.

The portion of the exclusive fishery limits of the State which lie;

(a) directly opposite that part of the baseline which passing through Stag Rocks, County Donegal, joins Bloody Foreland to Rinrawros Point, Aran Island,

(b) directly opposite that part of the baseline which passing through the Great Foze Rock joins Carrickakin, Achill Island to The Rogue, Mine Head, and

(c) between two lines drawn through the Rogue, Mine Head due south and south-east respectively.

EXPLANATORY NOTE.

The effect of this Order is to permit the vessels of Belgium, Britain, France, Germany, Netherlands and Spain, which have traditional fishing rights in certain areas for certain stocks of fish in the exclusive fishery limits around the Irish coast, which are indicated in the Order, to continue to fish in those areas in the six to twelve mile belt. In addition, vessels of those countries will be permitted to fish in the indicated areas in the three to six mile belt (a) until the end of 1965 where no straight baselines are drawn and (b) until the end of 1966 where such baselines are drawn. The Order is made under the Maritime Jurisdiction (Amendment) Act, 1964 .
