FRUIT (REGULATION OF IMPORT) ORDER, 1966. |
||
I, CHARLES J. HAUGHEY, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by section 2 of the Agricultural Products (Regulation of Import) Act, 1938 (No. 14 of 1938), as adapted by the Agriculture (Alteration of Name of Department and Title of Minister) Order, 1965 ( S.I. No. 146 of 1965 ), hereby, after consultation with the Minister for Finance and the Minister for Industry and Commerce, order as follows :-- |

1. (1) This Order may be cited as the Fruit (Regulation of Import) Order, 1966. |
||
(2) This Order shall come into operation on the 1st day of July, 1966. |
||
2. In this Order " the United Kingdom " means Great Britain, Northern Ireland, the Isle of Man and the Channel Islands. |
||
3. The importation of any articles specified in the Schedule to this Order is hereby prohibited save under and in accordance with a licence in that behalf issued by the Minister under this Order. |
||
4. (1) The Minister may, at his discretion, issue a licence to import a specified quantity of any articles specified in the Schedule to this Order. |
||
(2) Whenever the Minister issues a licence under this Order he may attach to the licence any one or more of the following conditions : |
||
(a) a condition that the article to which the licence relates shall be of a specified description ; |
||
(b) a condition that such article shall be imported within a specified time or during a specified period ; |
||
(c) a condition that such article shall be imported from a specified country ; |
||
(d) a condition that such article shall have been produced or manufactured in a specified country ; |
||
(e) a condition that such article shall be imported at a specified port or place or by a specified route ; |
||
(f) a condition that such article shall not be imported in more than a specified number of consignments ; |
||
(g) a condition that such article shall be imported by a specified person ; |
||
(h) a condition that such article shall be disposed of in a specified manner, for a specified purpose, or both in a specified manner and for a specified purpose. |
||
(3) The Minister may at any time revoke a licence issued under this Order. |
||
5. Any person who imports or attempts to import any article specified in the Schedule to this Order in contravention of this Order or who aids or abets the importation of any such article in contravention of this Order shall be guilty of an offence under this Order and shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds. |
||
6. The Fruit (Regulation of Import) Order, 1938 ( S. R. & O. No. 137 of 1938 ), is hereby revoked. |
||
SCHEDULE. |
||
1. Fruit which-- |
||
(a) is preserved in water, without the addition of sugar or other sweetening matter, and is of any of the following descriptions, namely, apples, currants, gooseberries, raspberries and strawberries, |
||
(b) is preserved in water, without the addition of sugar or other sweetening matter, and is of any of the following descriptions, namely, loganberries, pears, plums (including damsons, prunes and greengages) and cherries and is produced or manufactured in, or consigned from, a country other than the United Kingdom. |
||
2. Juice which-- |
||
(a) is wholly or partly derived or prepared from apples or currants and is unfermented, does not contain spirit and is produced or manufactured in and consigned from the United Kingdom, |
||
(b) is wholly or partly derived or prepared from fruit of any of the following descriptions, namely, apples, currants, gooseberries, raspberries, strawberries, loganberries, pears, plums (including damsons, prunes and greengages) and cherries and is produced or manufactured in, or consigned from, a country other than the United Kingdom. |
||
3. Pulp which-- |
||
(a) is wholly or partly derived or prepared from fruit of any of the following descriptions, namely, apples, currants, gooseberries, raspberries and strawberries, |
||
(b) is wholly or partly derived or prepared from fruit of any of the following descriptions, namely, loganberries, pears, plums (including damsons, prunes and greengages) and cherries and is produced or manufactured in, or consigned from, a country other than the United Kingdom. |
||

EXPLANATORY NOTE. |
||
The effect of this Order is to remove import licensing control on |
||
(a) certain fruits preserved in water, and |
||
(b) the juice and pulp of certain fruits, |
||
produced or manufactured in and imported from Great Britain, Northern Ireland, the Channel Islands or the Isle of Man. |
