ROAD TRAFFIC (SPEED LIMITS) (COUNTY BOROUGH OF WATERFORD AND COUNTY OF WATERFORD) REGULATIONS, 1967.

ROAD TRAFFIC (SPEED LIMITS) (COUNTY BOROUGH OF WATERFORD AND COUNTY OF WATERFORD) REGULATIONS, 1967.

The Minister for Local Government in exercise of the powers conferred on him by sections, 5, 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) and as respects article 7 after consultation with the Commissioner of the Garda Síochána and the road authorities concerned and as respects article 5, on the application of the said Commissioner hereby makes the following Regulations :--

Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County Borough of Waterford and County of Waterford) Regulations, 1967.

Commencement.

2. These Regulations shall come into operation on the 1st day of May, 1967.

Interpretation.

3. In these Regulations save where the context otherwise requires

" the Act " means the Road Traffic Act, 1961 ;

" road " means a public road;

" perimeter road " means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

" special speed limit " and " built-up area speed limit " have the meanings respectively assigned to them in Part IV of the Act;

" distance " means distance as measured along the centre line of a road.

Built-up area Speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following :--

(a) ambulances,

(b) fire brigade vehicles, and

(c) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

Revocation.

7. Articles 5 and 6 of the Road Traffic (Speed Limits) Regulations, 1963 ( S.I. No. 18 of 1963 ) as amended by the Road Traffic (Speed Limits) (Amendment) Regulations, 1965 ( S.I. No. 86 of 1965 ) in so far as they relate to roads in the County Borough of Waterford and the County of Waterford are hereby revoked.

FIRST SCHEDULE

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the Urban District of Dungarvan :--

(a) Boreen a'Willan, The Apple Factory Road, The Kilrush Graveyard Road, The Mapestown Road, the Lisfennel Road, Fr. Toomey's Road, The Knockateemore Road.

(b) The Waterford (Coast) Road for a distance of 1,510 yards from the Urban District boundary.

(c) The main Waterford Road between the Urban District boundary and a point 240 yards north-east of its junction with the Waterford (Coast) Road.

(d) The Old Hospital Road for a distance of 1,030 yards from the Urban District boundary.

(e) The Shandon Road between the Urban District boundary at Ballyneety Bridge and a point 10 yards north of its junction with the inner Station Road.

(f) The road connecting Kilrush Graveyard Road with the Apple Factory Road.

(g) The Cappoquin Road for a distance of 1,000 yards from the point where the Urban District boundary intersects the southern side of the road.

(h) The Clashmore Road between the Urban District boundary and a point 80 yards west of its westernmost junction with Congress Villas.

(i) The Youghal Road for a distance of 810 yards from the Urban District boundary.

2. The following roads in the town of Lismore :--

(a) The Deerpark Road.

(b) The Cappoquin Road between the town boundary and a point 70 yards north of its junction with Main Street.

(c) Ferry Lane between its junction with the Cappoquin Road and a point 120 yards north of its junction with Main Street.

3. The following roads in the town of Tramore :--

(a) The Glen Road, Racecourse Road, Penrose Lane, The Kilfarrasy Road, The Metal Man Road.

(b) The Riverstown Road between its junction with the main Waterford Road and a point 500 yards north of its junction with the Promenade.

(c) The main Waterford Road between the town boundary and a point 60 yards south-west of its junction with the Riverstown Road.

(d) The road connecting the main Waterford Road with the Old Waterford Road.

(e) The Old Waterford Road between its junction with the main Waterford Road and a point 20 yards north-east of its junction with Marian Terrace.

(f) The Carrick Road between the town boundary and a point 150 yards north of its junction with Marian Terrace.

(g) The Knockanduff Road for a distance of 800 yards from the town boundary.

(h) The Bonmahon Road between the town boundary and a point 100 yards south-west of its junction with the Newtown Road.

(i) The Newtown Road between its junction with the Metal Man Road and a point 95 yards south-east of its junction with the Bonmahon Road.

4. The following roads in the County Borough of Waterford :--

(a) The Knockhouse Road, Quarry Road, The Lacken Road, The Ballindud Road.

(b) The Lower Grange Road for a distance of 265 yards from the point where the County Borough boundary intersects the eastern side of the road.

(c) The Tramore Road between the County Borough boundary and a point 200 yards south of its junction with the Cork Road.

(d) The Cork Road between its westernmost intersection by the County Borough boundary and a point 60 yards south-west of its junction with O'Reilly Road.

(e) The Roanmore Road for a distance of 220 yards from Kilbarry Cross Roads.

(f) Brown's Road between the County Borough boundary and a point 330 yards south west of its junction with Lisduggan Road.

(g) The Lisduggan Road between the County Borough boundary and a point 260 yards west of its junction with Brown's Road.

(h) The Cleaboy Road between the County Borough boundary and a point 120 yards south-west of its junction with Marian Park.

(i) The Gracedieu Road between the County Borough boundary and a point 200 yards south-east of its junction with the Knockhouse Road.

(j) The Bilberry Road between the County Borough boundary and a point 340 yards north-west of its junction with Waterford Bridge.

SECOND SCHEDULE

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads at Ardmore :--

(a) The Cliff Road, Coffey Lane, Main Street, The Rocky Road, St. Declan's Row.

(b) Dawson's Road and the road connecting it with the Cliff Road.

(c) The Dungarvan Road for a distance of 160 yards from its junction with Main Street.

(d) The Youghal Road for a distance of 550 yards from its junction with Tower Hill.

(e) Tower Hill between its junction with Main Street and a point 10 yards south of its junction with the Rocky Road.

2. The following roads at Ballyduff :--

(a) The Fermoy-Lismore road between a point 220 yards west of its junction with the Tallow Road and a point 200 yards east of the said junction.

(b) The Tallow Road for a distance of 230 yards from its junction with the Fermoy-Lismore road.

(c) The Baranvalla Road for a distance of 100 yards from its junction with the Fermoy-Lismore road.

3. The following roads at Cappoquin :--

(a) Castle Street, Green Street, Mass Lane, Mill Street, O'Donoghue's Terrace, Twig Lane, Church Street.

(b) The main Lismore-Dungarvan road between a point 50 yards south-east of its junction with the Camphire or Rock Road and a point 220 yards south of its junction with Mill Street.

(c) The Mount Melleray Road for a distance of 820 yards from its junction with the main Lismore-Dungarvan road.

4. The following roads at Clashmore :--

(a) Khakitown Road.

(b) The Clonmel-Youghal road between a point 160 yards east of its junction with the Kilmore Road and a point 100 yards south-east of its junction with the Hill Road.

(c) The Kilmore Road for a distance of 240 yards from its junction with the Clonmel-Youghal road.

5. The following roads at Dunmore East :--

(a) The Circular Road, King's Terrace, Long's Hill, The Nymphall Road, The Park Road, Sunnyside, Marian Terrace, Wellington Terrace.

(b) The Killea Road for a distance of 470 yards from its junction with Horsequarter Road.

(c) Horsequarter Road for a distance of 100 yards from its junction with Long's Hill.

(d) The Waterford Road for a distance of 120 yards from its junction with the Ballymacaw Road.

(e) The Ballymacaw Road for a distance of 100 yards from its junction with the Waterford Road.

(f) The Dock Road and its continuation southwards to a point 50 yards north of the junction of the said continuation with the Red Road.

6. The following roads at Kilmacthomas :--

(a) High Lane, High Street, Main Street, The Square, St. Anne's Terrace.

(b) The Carrick New Line for a distance of 50 yards from its junction with Main Street.

(c) The Graigue Road between its junction with the Newtown Road and a point 10 yards north-east of its junction with High Lane.

(d) The Newtown Road between its junction with Main Street and a point 470 yards east of its junction with the Graigue Road.

(e) The road to the New Bridge for a distance of 60 yards from its junction with Main Street.

(f) The Well Road for a distance of 230 yards from its junction with the Dungarvan Road.

(g) The Dungarvan Road for a distance of 120 yards from its junction with Main Street.

(h) The Currabaha Road for a distance of 230 yards from its junction with the Dungarvan Road.

7. The following roads adjacent to the town of Lismore :--

(a) The Parks Road, Hospital Lane, Parks Road housing scheme cul-de-sac, Townparks housing scheme cul-de-sac.

(b) The Convent Road between the boundary of the town of Lismore and a point 350 yards east of its junction with the Deerpark Road.

(c) The part of the Mayfield Road which lies outside the boundary of the town of Lismore where the said road is a perimeter road.

(d) Chapel Street and its continuation as the Union Road between the point where the boundary of the town of Lismore intersects the eastern side of the road and a point 30 yards south-west of the junction of Union Road with Townparks housing scheme cul-de-sac.

(e) The part of the Ballyanchor Road which lies outside the boundary of the town of Lismore where the said road is a perimeter road.

8. The following roads at Passage East :--

All roads in the area enclosed by a line commencing at a point on the Waterford Road 130 yards north-west of its junction with Barrack Square and drawn thence in straight lines successively to the following points :--

(a) the eastern terminal point of the Custom House Quay,

(b) the eastern terminal point of the Breakwater,

(c) a point on the Woodstown Road 230 yards south of its junction with Dobbyn Street

and from the last-mentioned point in a straight line to the commencement point on the Waterford Road.

9. The following roads at Portlaw :--

All roads in the area enclosed by a line commencing at a point on the eastern edge of the Carrick Road 50 yards north of its junction with Connolly Road and drawn thence in straight lines successfully to the following points :--

(a) a point on the Priest's Road 20 yards east of its junction with the Carrick Road,

(b) a point on the Kilmacthomas Road 80 yards south of the centre point of Portlaw Bridge,

(c) the westernmost point of Bridge Street,

(d) a point on the Factory Road 80 yards west of its junction with Church Road,

(e) a point on Pigott's Cross Road 160 yards north-west of its junction with Connolly Road

and from the last mentioned point in a straight line to the commencement point on the Carrick Road.

10. The following roads at Stradbally :--

(a) The Square, Church Lane.

(b) The Kilmacthomas Road for a distance of 60 yards from its junction with the Square.

(c) High Street and its continuation as the Old Coast Road for a distance of 330 yards from the junction of High Street with the Cove Road.

(d) Nunnery Lane for a distance of 110 yards from its junction with the Cove Road.

(e) The Cove Road between its junction with High Street and a point 45 yards south of its junction with Nunnery Lane.

11. The following roads at Tallow :--

All roads in the area enclosed by a line commencing at a point on the Lismore Road 650 yards north of its junction with Chapel Street and drawn thence in straight lines successively to the following points :--

(a) a point on Townparks Road 500 yards east of the junction of Chapel Street with the Lismore Road,

(b) a point on the Youghal Road 100 yards south-east of its junction with the Kilcalf Road,

(c) a point on the Kilcalf Road 170 yards south of its junction with the Youghal Road,

(d) a point on the Midleton Road 60 yards south of its junction with Cockpit Lane,

(e) a point on West Street 650 yards west of its junction with the Lismore Road

and from the last-mentioned point in a straight line to the commencement point on the Lismore Road.

12. The following roads adjacent to the County Borough of Waterford :--

(a) The Upper Grange Road for a distance of 100 yards from the boundary of the County Borough of Waterford.

(b) The Lower Grange Road between the point where the boundary of the County Borough of Waterford intersects the western side of the road and a point 265 yards northwest of the point where the said boundary intersects the eastern side of the road.

(c) The Old Tramore Road for a distance of 70 yards from the boundary of the County Borough of Waterford.

THIRD SCHEDULE

Roads in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following road at Annestown :--

The Tramore-Bonmahon road between the eastern end of Annestown Bridge and a point 70 yards west of its junction with the Ballyheadon Road.

2. The following road in the Urban District of Dungarvan :--

The Waterford (Coast) Road between a point 1,510 yards southwest of the Urban District boundary and a point 930 yards southwest of the said boundary.

3. The following roads in and adjacent to the County Borough of Waterford :--

(a) Dunmore Road between the boundary of the County Borough of Waterford and a point 185 yards south-east of its junction with the Maypark Road.

(b) The Cork Road between a point 60 yards south-west of its junction with O'Reilly Road and a point 440 yards southwest of the said junction.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) Regulations, 1963 and 1965, in their application to the County Borough of Waterford and the County of Waterford, and alter the speed limits applicable to certain roads in these areas.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule for all mechanically propelled vehicles.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
