S.I. No. 79/1967:

SOCIAL WELFARE (PERSONS TREATED AS EMPLOYERS) REGULATIONS, 1967.

SOCIAL WELFARE (PERSONS TREATED AS EMPLOYERS) REGULATIONS, 1967.

I, JOSEPH BRENNAN, Minister for Social Welfare, in exercise of the powers conferred on me by subsection (4) of section 2 and section 3 of the Social Welfare Act, 1952 (No. 11 of 1952), hereby make the following Regulations :--

1. These Regulations may be cited as the Social Welfare (Persons Treated as Employers) Regulations, 1967.

2. In these Regulations--

" the Acts " means the Social Welfare Acts, 1952 to 1966.

3. These Regulations and the Social Welfare (Persons Treated as Employers) Regulations, 1953 ( S.I. No. 21 of 1953 ), may be cited together as the Social Welfare (Persons Treated as Employers) Regulations, 1953 and 1967.

4. These Regulations shall come into operation on the 1st day of May, 1967.

5. In relation to the employment specified in the first column of the Schedule to these Regulations, the person specified opposite thereto in the second column shall for the purposes of the Acts be treated as the employer of the employed contributor employed in that employment.

SCHEDULE

EMPLOYMENTS IN RESPECT OF WHICH PERSONS ARE TREATED AS EMPLOYERS.

EMPLOYMENT.

PERSON TREATED AS EMPLOYER.

Employment in the State in plying for hire with any vehicle, vessel, aircraft, machine or animal, the use of which is obtained under any contract of bailment (other than a hire purchase agreement) in consideration of the payment of a fixed sum or a share in the earnings or otherwise.

The person from whom the use of the vehicle, vessel, aircraft, machine or animal is so obtained.

EXPLANATORY NOTE.

These Regulations specify the persons to be treated for the purposes of the Social Welfare Acts, 1952 to 1966, as the employer of a person employed as specified therein in plying for hire under a contract of bailment (other than a hire purchase agreement). Employment of this nature is insurable under the Social Welfare (Occupational Injuries) Act, 1966 .
