ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) REGULATIONS, 1968. |

The Minister for Local Government in exercise of the powers conferred on him by section 12 of the Roads Act, 1920, and sections 1 and 3 of the Finance (Excise Duties) (Vehicles) Act, 1952 (No. 24 of 1952) hereby makes the following Regulations:-- |
||
1. (1) These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1968. |
||
(2) These Regulations and the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1966, shall be construed as one and may be cited together as the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1968. |
||
(3) These Regulations shall come into operation on the 1st day of July, 1968. |
||
2. In these Regulations-- |
||
"the Principal Regulations" means the Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ). |
||
3. Paragraph (a) of sub-article (2) of article 22 of the Principal Regulations is hereby amended by the insertion of "save an application in respect of a vehicle exempt from duty by virtue of the provisions of the Diplomatic Relations and Immunities Act, 1967 (No. 8 of 1967)" before "shall". |
||
4. Article 26 of the Principal Regulations (as substituted by the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1966 ( S.I. No. 13 of 1966 ) shall be amended as follows:-- |
||
( a ) by the substitution in paragraph (a) of "any month" for "March, June, September or December". |
||
( b ) by the substitution for paragraph (b) of the following paragraph:-- |
||
"(b) A licence may be taken out for a period of six months ending on the last day of any month on payment of eleven twentieths of the full annual rate of duty (any fraction of a shilling in the amount so calculated being treated as a shilling if it exceeds sixpence and otherwise being disregarded)." |
||
5. Sub-article (2) of article 27 of the Principal Regulations is hereby amended by the insertion of "not being a rotary piston engine" before "shall". |
||
6. Article 27 of the Principal Regulations is hereby amended by the insertion after sub-article (2) of the following sub-articles:-- |
||
"(2A) For the purpose of any rate of duty specified in the Schedule to the Act of 1952 the horsepower of any vehicle deriving its motive power wholly from a rotary-piston engine shall be the total horsepower attributable to the rotary-pistons calculated in respect of each rotary-piston by dividing the displacement volume attributable to the rotary-piston by 62.5 times the number of output shaft revolutions for one revolution of the rotary piston. |

(2B) In this article:-- |
||
'rotary-piston engine' means an engine with one or more rotary-pistons, each of which produces power by acting on an eccentric which is directly attached to an output shaft; |
||
'output shaft' means a shaft to which a rotary-piston is directly coupled without gearing or other similar devices intervening; |
||
'displacement volume attributable to the rotary-piston' means the difference between the maximum and minimum volumes, expressed in cubic centimetres, of a single working chamber based on a working flank of the rotary-piston multiplied by the number of working flanks of the rotary piston." |

7. Article 3 of the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1958 ( S.I. No. 198 of 1958 ) is hereby amended by the addition of the following clauses-- |
||
( d ) the owner of the vehicle has ceased, because of service overseas with the Defence Forces, to use the vehicle, or |
||
( e ) the owner of the vehicle has ceased, because of absence from the State for business or educational purposes, to use the vehicle. |
||

EXPLANATORY NOTE. |
||
These Regulations amend the Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ) and the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1958 ( S.I. No. 198 of 1958 ) so as to provide:-- |
||
1. that motor taxation licences may be issued in respect of vehicles owned by diplomatic missions, which are exempt from motor taxation, at the same intervals as those applying to vehicles which are subject to taxation; |
||
2. for the issue of motor taxation licences for any period of three months or of six months (in addition to the existing provision of any period of twelve months) issue of a licence for a period of one or two months to be discontinued; |
||
3. for the calculation of horsepower of rotary piston engines; and |
||
4. for additional cases in which the holder of a motor vehicle duty licence may surrender the licence and apply for a repayment of duty. |
