HEALTH (OFFICERS AGE LIMIT) ORDER, 1971 |

The Minister for Health, in exercise of the powers conferred on him by section 19 of the Health Act, 1970 (No. 1 of 1970) hereby determines as follows:-- |
||
1. This Order may be cited as the Health (Officers Age Limit) Order, 1971. |
||
2. (a) The age of seventy years shall be the age limit in respect of each of the following officers:-- |
||
(i) permanent district medical officers; |
||
(ii) permanent officers, who immediately prior to their transfer to health boards, were holders of an amalgamated office, comprising an office of district medical officer of a dispensary district and another office; |
||
(iii) permanent officers who are not by law entitled to or capable of being granted a superannuation allowance on their resigning or otherwise ceasing to hold office. |
||
(b) The age limit in respect of an officer who is not by law entitled to or capable of being granted a superannuation allowance on resigning or otherwise ceasing to hold office at the age of sixty-five years shall be the age at which he becomes entitled to or capable of being granted such an allowance. |

EXPLANATORY NOTE. |
||
This Order fixes age limits higher than the statutory limit of sixty-five years for certain officers under health boards. The higher age limit determined by the Minister in this Order is seventy years but for an officer whose entitlement to a pension would depend on his having longer service than he would have were he to retire at sixty-five years the age limit is the age at which he becomes entitled to pension. |
