FACTORIES (FEES OF CERTIFYING DOCTORS) REGULATIONS, 1971. |

I, JOSEPH BRENNAN, Minister for Labour, in exercise of the powers conferred on me by section 97 of the Factories Act, 1955 (No. 10 of 1955), and the Labour (Transfer of Departmental Administration and Ministerial Functions) Order, 1966 ( S.I. No. 164 of 1966 ), hereby make the following regulations: |

1. (1) These Regulations may be cited as the Factories (Fees of Certifying Doctors) Regulations, 1971. |
||
(2) These Regulations shall come into operation on the first day of September, 1971. |
||
2. In these Regulations "the Act" means the Factories Act, 1955 (No. 10 of 1955). |
||
3. (1) Without prejudice to any agreement between a certifying doctor and the occupier of a factory for the payment of fees of a greater amount, the fees to be paid to certifying doctors for carrying out-- |
||
(a) their duties in relation to examination of young persons under section 80 of the Act, including the issue or refusal of a certificate of fitness under subsection (1) or subsection (2) and the issue of a provisional certificate under subsection (3), of that section, and |
||
(b) their duties in relation to examination of women or young persons in accordance with regulations made for the purposes of section 70 of the Act and examination of persons employed in accordance with special regulations made for the purposes of section 71 of the Act, including any entries in registers, issue of certificates and the carrying out of other duties as may be required by the regulations in connection with the examination, |

shall be: |
||
(i) where the examination is at the place of employment 80p for each person examined (with a minimum fee of £2.40 for any one visit) together with, if the place of employment is one and one-half miles or more from the central point, 6p for each complete half-mile over one mile, and |
||
(ii) where the examination is not at the place of employment but at a place appointed by the certifying doctor for the purpose, 75p for each person examined. |
||
(2) In this Regulation "the central point" means a place fixed by the Minister for Labour with respect to the certifying doctor as the place for the calculation of mileage for the purpose of this Regulation or, where no place is so fixed, the residence of the certifying doctor. |
||
4. The Factories (Fees of Certifying Doctors) Regulations, 1965 ( S.I. No. 205 of 1965 ), are hereby revoked. |

EXPLANATORY NOTE. |
||
This Instrument prescribes the minimum fees to be paid to certifying doctors for certain of their duties under the Factories Act, 1955 . |
