VETERINARY SURGEONS ORDER, 1972. |
||
The Government, being satisfied, after consultation between the Minister for Agriculture and Fisheries and the Veterinary Council, that it is necessary to reconstitute that Council, in exercise of the powers conferred on them by section 5 of the Veterinary Surgeons Act, 1952 (No. 18 of 1952), hereby order as follows: |
||
1. (1) This Order may be cited as the Veterinary Surgeons Order, 1972. |
||
(2) The Principal Order and this Order may be cited together as the Veterinary Surgeons Orders, 1954 and 1972. |
||
2. Subject to Article 3 of this Order, the Principal Order and this Order shall be construed together as one. |
||
3. In this Order-- |
||
" the appointed day " means such day as the Minister, after consultation with the Council, shall appoint; |
||
" the Principal Order " means the Veterinary Surgeons Order, 1954 ( S.I. No. 68 of 1954 ). |
||
4. (1) On the appointed day the existing members of the Council shall vacate office and from that day the Council shall be re-constituted in accordance with the following provisions of this Article and, accordingly, the Principal Order shall be construed and have effect in the manner specified in Article 5 of this Order. |
||
(2) The Council shall consist of the following members, namely : |
||
(a) twelve elected members, elected in the manner provided in the Principal Order, |
||
(b) one member appointed by the Minister, |
||
(c) one member appointed by each university granting a degree in the case of which an order under section 2 (1) of the Act of 1952 is for the time being in force. |
||
(3) Two of the elected members of the Council, who shall be known as general elected members, shall be registered veterinary surgeons who are for the time being also registered in the general register and are resident in the State; and such general elected members shall be elected by the registered veterinary surgeons who are for the time being also registered in the general register and resident in the State. |
||
(4) (a) The elected members of the Council who are not general elected members shall be known as limited elected members. |
||
(b) The limited elected members shall be registered veterinary surgeons resident in the State and shall be elected by the registered veterinary surgeons who are for the time being resident in the State. |
||
(c) Registration in the general register shall not disqualify for being elected or holding office as a limited elected member or for voting at an election of limited elected members. |
||
(5) This Article shall have effect in lieu of sections 3 (3) and 7 of the Act of 1931 and, accordingly, Article 4 of the Principal Order shall be disregarded. |
||
5. (1) The Principal Order shall be construed and have effect as if-- |
||
(a) " ten limited elected members " were substituted for " five limited elected members " in Article 5 (1); |
||
(b) " five limited elected members " were substituted for " three limited elected members or of two limited elected members, as the case may be " in Article 5 (2); and |
||
(c) " the five " were substituted for " the three " in Article 7 (3) (c). |
||
(2) The references to the appointed day in Articles 5 and 6 of the Principal Order shall each be construed as a reference to the appointed day within the meaning of this Order. |
||
(3) On and from the appointed day the Principal Order shall be construed and have effect as if-- |
||
(a) " six members " were substituted for " four members " in Article 11 (1); and |
||
(b) " nine " were substituted for " six " in Article 14 (1). |

EXPLANATORY NOTE. |
||
The Order provides for the reconstitution of the Veterinary Council, the reconstituted Council to consist of twelve elected members and also specified appointed members, and, as well, provides for certain consequential changes relating to the election of elected members and the quorum for meetings of the Council. |
||
