S.I. No. 135/1974:

LOCAL ELECTIONS (PETITIONS AND DISQUALIFICATIONS) ACT, 1974 (SECTION 25) ORDER, 1974.

LOCAL ELECTIONS (PETITIONS AND DISQUALIFICATIONS) ACT, 1974 (SECTION 25) ORDER, 1974.

The Minister for Local Government in exercise of the powers conferred on him by section 25 (1) of the Local Elections (Petitions and Disqualifications) Act, 1974 (No. 8 of 1974) hereby orders as follows:--

1. This Order may be cited as the Local Elections (Petitions and Disqualifications) Act, 1974 (Section 25) Order, 1974.

2. In this Order--

"the Act of 1926" means the Local Authorities (Officers and Employees) Act, 1926 (No. 39 of 1926).

3. The following classes, descriptions and grades of offices and employments are hereby designated as classes, descriptions and grades of offices and employments for the purpose of section 25 (1) (b) of the Local Elections (Petitions and Disqualifications) Act, 1974 , that is to say:--

( a ) all classes, descriptions and grades of employments as a servant,

( b ) all classes, descriptions and grades of offices other than:--

(i) offices to which the Act of 1926 applies,

(ii) offices of a class, description or grade set out in the Schedule to this Order.

SCHEDULE.

1. Every office the duties of which are wholly or mainly of an administrative, executive or clerical nature and the maximum remuneration for which exceeds the maximum remuneration for the office of Clerical Officer.

2. Every temporary office to which the Act of 1926 would apply if it were a permanent office, every part-time office of engineer or surveyor under the council of an urban district or the commissioners of a town, and every office of clerk of the commissioners of a town which is not an urban district.

3. Every office of Assistant Librarian, Chief Assistant Public Libraries, Chief Cataloguer Public Libraries, Supervisor Public Libraries, Librarian Grade A, and Librarian Grade B.

4. Every office of Chief Fire Officer, Second Fire Officer, Third Fire Officer and District Officer Fire Brigade.

5. Every office of Rate Collector, Rent Collector, Rate Inspector, Rent Inspector, Investigation Officer or analogous office, Housing Welfare Officer, Social Worker, Superintendent Assistance Officer, Deputy Superintendent Assistance Officer, Home Assistance Inspector, Assistance Officer and Fuel Inspector.

6. Every office of Chief Inspector Weights and Measures, Inspector Weights and Measures, and Assistant Inspector Weights and Measures.

7. Every office of Clerk-of-Works.

8. Every office of Inspector, Superintendent, Supervisor or other analogous office, the maximum remuneration for which is not less than the maximum remuneration for the office of Clerical Officer.

EXPLANATORY NOTE.

This Order made by the Minister for Local Government under Section 25 (1) of the Local Elections (Petitions and Disqualifications) Act, 1974 designates the classes, descriptions and grades of offices and employments which are no longer affected by the prohibition on holding office or being employed under a local authority contained in Section 21 (1) of the Local Government Act, 1955 . Heretofore no person could hold any office of profit under or be employed for remuneration by or under any local authority while he was a member of that local authority.
