SOCIAL WELFARE (DESERTED WIFE'S ALLOWANCE) (AMENDMENT) REGULATIONS, 1976. |

The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of the Social Welfare Act, 1952 (No. 11 of 1952) and sections 21 and 22 of the Social Welfare Act, 1970 (No. 12 of 1970), hereby makes the following Regulations:-- |

1. (1) These Regulations may be cited as the Social Welfare (Deserted Wife's Allowance) (Amendment) Regulations, 1976. |
||
(2) These Regulations and the Social Welfare (Deserted Wife's Allowance) Regulations, 1970 to 1974, may be cited collectively as the Social Welfare (Deserted Wife's Allowance) Regulations, 1970 to 1976. |
||
2. These Regulations shall come into operation on the 11th day of June, 1976. |

3. Article 8 of the Social Welfare (Deserted Wife's Allowance) Regulations, 1970 ( S.I. No. 227 of 1970 ) is hereby amended by the substitution in sub-article (1) for the words "and 63." of the words "63 and 80 (2)." and by the insertion after sub-article (3) of the following sub-article-- |

"(4) In the application of section 80 (2) of the said Act any reference to "widow's (non-contributory) pension under the Widows' and Orphans' Pensions Acts, 1935 to 1952" shall be construed as including an allowance." |

EXPLANATORY NOTE. |
||
These Regulations amend the Social Welfare (Deserted Wife's Allowance) Regulations, 1970 to 1974, by providing that a person who, immediately before attaining pensionable age, is in receipt of a deserted wife's allowance shall not be required to satisfy the residence conditions for old age (non-contributory) pensions purposes imposed by section 2 of the Old Age Pensions Act, 1932 . |
