The Minister for Local Government in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) amended as regards the said section 46 by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:-- |

Citation. | ||
1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Kerry) Regulations, 1977. |
||
Commencement. | ||
2. These Regulations shall come into operation on the 30th day of May, 1977. |
||
Interpretation. | ||
3. In these Regulations save where the context otherwise requires |
||
"the Act" means the Road Traffic Act, 1961 ; |
||
"road" means a public road; |
||
"perimeter road" means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town; |
||
"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act; |
||
"distance" means distance as measured along the centre line of a road. |
||
Built-up area speed limit. | ||
4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act. |
||
(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act. |
||
Special speed limit. | ||
5. Forty mile per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations. |
||
Exceptions. | ||
6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following: -- |
||
(a) ambulances, |
||
(b) fire brigade vehicles, and |
||
(c) vehicles used by members of the Garda Síochána in the performance of their duties as such members. |
||
Revocation. | ||
7. The Road Traffic (Speed Limits) (County of Kerry) Regulations, 1967 ( S.I. No. 208 of 1967 ) and the Road Traffic (Speed Limits) (County of Kerry) (Amendment) Regulations, 1971 ( S.I. No. 242 of 1971 ) are hereby revoked. |

FIRST SCHEDULE. |
||
Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 . |

1. The following roads in the Urban District of Killarney:-- |
||
(a) Ross Road. |
||
(b) Emmett's Road or Lewis Road and its continuation as the Kilcummin Road between the urban district boundary and a point 64 metres north of its junction with d'Alton's Terrace. |
||
(c) The Cork Road between the urban district boundary and a point 90 metres south-east of its junction with the Spa Road. |
||
(d) Woodlawn Road between its junction with the Cork Road and a point 27 metres north-east of its junction with the Ballycasheen Road. |
||
(e) Flesk Road for a distance of 140 metres from the urban district boundary. |
||
2. The following roads in the Urban District of Listowel:-- |

(a) The Ballygrenane Road. |

(b) The Greenville Road for a distance of 612 metres from the urban district boundary. |

(c) The Ballybunion Road between the urban district boundary and a point 137 metres north-west of its junction with the Greenville Road. |

(d) The Ballylongford Road for a distance of 731 metres from the urban district boundary. |

(e) The Ballygowloge Road between the urban district boundary and a point 548 metres north-east of its junction with the Tarbert Road. |
||
(f) The Duagh Road between the urban district boundary and a point 4 metres north-west of its junction with the Ballygrenane Road. |
||
(g) The Tralee Road between the urban district boundary and a point 45 metres south-west of its junction with the Duagh Road. |

(e) The Abbeydorney Road between the urban district boundary and a point 405 metres north-east of its junction with Buntalloon Road. |

(f) Buntalloon Road between the urban district boundary and a point 18 metres north-west of its junction with St. Brendan's Park. |
||
(g) Oakpark Road between the urban district boundary and a point 950 metres north-east of its junction with Riverside. |
||
(h) The Clash Road between the urban district boundary and a point 366 metres north-east of its junction with Quill Street. |
||
(i) The Ballyard Road between the urban district boundary and a point 45 metres south-west of its junction with the Dingle Road. |
||
(j) The Dingle Road between a point 95 metres east of the centre line of Blennerville Bridge and a point 95 metres west of the centre line of Mulgrave Bridge. |

2. The following roads at Annascaul:-- |
||
(a) The Tralee-Dingle road between a point 92 metres south-west of its junction with the Derrygorman Road and a point 235 metres south-west of the centre line of Annascaul Bridge. |
||
(b) The Ballinacourty Road for a distance of 7 metres from its junction with the Dingle-Tralee road. |

(d) The Fenit or Chapel Road for a distance of 147 metres from its junction with the Tralee-Ballyheigue road. |

(a) the southern terminal point of Top Street, |

(b) a point on the Waterville Road 947 metres south-west of its junction with Old Post Office Street, |
||
(c) the western terminal point of the Breakwater, |

(d) a point on Bridge Street 50 metres north-west of its junction with Marconi Terrace, |

(c) The Dingle Road for a distance of 183 metres from its junction with the Tralee-Caherciveen road. |

12. The following roads at Causeway :-- |

(a) The Ballyheigue-Ballyduff road between a point 366 metres south-west of its junction with the Sea Road and a point 298 metres north-east of the said junction. |

(b) The Ardfert Road for a distance of 183 metres from its junction with the Ballyheigue-Ballyduff road. |

(c) The Sea Road for a distance of 412 metres from its junction with the Ballyheigue-Ballyduff road. |

All roads in the area enclosed by a line commencing at a point on Strand Road 412 metres south-east of Milltown Cross and drawn thence in straight lines successively to the following points:-- |

(a) the southern terminal point of the Coastguard Station Road, |
||
(b) the southern terminal point of John Street, |
||
(c) a point on the old Connor Hill Road 295 metres north-east of its junction with Spa Road, |
||
(d) a point on Spa Road 660 metres north-east of its junction with Main Street, |
||
(e) the northern terminal point of Chapel Lane, |
||
(f) a point on Goat Street 23 metres south-east of Workhouse Cross, |
||
and from the last-mentioned point in a straight line to the commencement point on Strand Road. |

(c) The Rossbeigh Road for a distance of 92 metres from its junction with the Tralee-Caherciveen road. |

All roads in the area enclosed by a line commencing at a point on the Glengarriff Road 15 metres north of its junction with Pier Road and drawn thence in straight lines successively to the following points:-- |

(a) a point on the Kilgarvan Road 70 metres north-east of its junction with Main Street, |
||
(b) a point of the Hospital Road 357 metres north-east of its junction with the Square, |
||
(c) a point on the Killarney Road 275 metres north-west of its junction with the Square, |

(d) a point on the Tubbrid Road 147 metres south-west of its junction with the Killarney Road, |

and from the last-mentioned point in a straight line to the commencement point on the Glengarriff Road. |

(b) The Listowel-Abbeyfeale road between a point 252 metres north-west of its junction with the Lisroe Road and a point 480 metres south-east of the said junction. |

(c) The Lisroe Road for a distance of 46 metres from its junction with the Listowel-Abbeyfeale road. |
||
3. The following roads at Farranfore:-- |
||
(a) The Tralee-Killarney road between a point 95 metres south-east of its junction with the Castleisland Road and a point 690 metres south-east of the said junction. |

(b) The Fieries Road for a distance of 96 metres from its junction with the Tralee-Killarney road. |

(c) The Currow Road for a distance of 110 metres from its junction with the Tralee-Killarney road. |

(b) Oakpark Road between a point 950 metres north-east of its junction with Riverside and a point 1,225 metres north-east of the boundary of the urban district of Tralee. |

(c) The Dingle Road between a point 95 metres east of the centre line of Blennerville Bridge and a point 95 metres west of the centre line of Mulgrave Bridge. |

EXPLANATORY NOTE. |
||
These Regulations replace the Road Traffic (Speed Limits) (County of Kerry) Regulations, 1967 ( S.I. No. 208 of 1967 ) and the Road Traffic (Speed Limits) (County of Kerry) (Amendment) Regulations, 1971 ( S.I. No. 242 of 1971 ) and alter the speed limits applicable to certain roads in this area. |
||
The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit. |
||
The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule. |
||
Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations. |
||
