ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF OFFALY) REGULATIONS, 1978.

ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF OFFALY) REGULATIONS, 1978.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) amended as regards the said section 46 by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:--

Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Offaly) Regulations, 1978.

Commencement.

2. These Regulations shall come into operation on the 27th day of February, 1978.

Interpretation.

3. In these Regulations save where the context otherwise requires--

"the Act" means the Road Traffic Act, 1961 ;

"road" means a public road;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road.

Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:--

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by mimbers of the Garda Síochána in the performance of their duties as such members.

Revocations.

7. The Road Traffic (Speed Limits) (County of Offaly) Regulations, 1968 ( S.I. No. 132 of 1968 ) and the Road Traffic (Speed Limits) (County of Offaly) (Amendment) Regulations, 1972 ( S.I. No. 27 of 1972 ) are hereby revoked.

FIRST SCHEDULE.

Roads in the County of Offaly declared not to be public roads in a built-up area for the purposes of Section 45 of the Road Traffic Act, 1961 .

1. The following roads in the Urban District of Birr:--

( a ) The Croghan Road, The New Line, The Rath Road, The Whiteford Road, Rock Lane, Orchard Lane.

( b ) The Banagher Road for a distance of 777 metres from the point where the urban district boundary intersects the eastern side of the road.

( c ) The Athlone Road etc.

( d ) Burke's Hill Road for a distance of 1,052 metres from its junction with the New Line.

( e ) The Kinnitty or Syngefield Road between the urban district boundary at Springfield Bridge and a point 782 metres north-west of its junction with the Whiteford Road.

( f ) The Roscrea Road between the urban district boundary and a point 101 metres south of its junction with Military Road.

( g ) Moorpark Road between its junction with the Roscrea Road and a point 5 metres north of its junction with Orchard Lane.

( h ) The Gallows Hill Road for a distance of 476 metres from its junction with the Riverstown Road.

( i ) The Military Road between the urban district boundary and a point 96 metres south-east of its junction with the Roscrea Road.

( j ) The Seefin Road between the urban district boundary and a point 152 metres east of its junction with the Roscrea Road.

( k ) The Riverstown Road between the urban district boundary and a point 396 metres south-west of its junction with the Railway Road.

2. The following roads in the town of Edenderry:--

( a ) The Carrick Road between the town boundary and a point 64 metres north-west of its junction with J.K.L. Street.

( b ) Clonmullen Lane between its junctIon with the Carrick Road and a point 23 metres north of its junction with Colonel Perry Street.

( c ) The Dublin Road for a distance of 914 metres from the town boundary.

( d ) The Cush Road for a distance fo 1,252 metres from the town boundary.

3. The following roads in the Urban District of Tullamore:--

( a ) Collins Lane, The Tinnycross Road.

( b ) The Rahan Road for a distance of 933 metres from the point where the urban district boundary intersects the western side of the road.

( c ) The Clara Road for a distance of 438 metres from the urban district boundary.

( d ) The Kilbeggan Road for a distance of 438 metres from the urban district boundary.

( e ) The Puttaghan or Ballydaly Road for a distance of 420 metres from the urban district boundary.

( f ) The Daingean Road for a distance of 566 metres from the urban district boundary.

( g ) The Portarlington Road for a distance of 685 metres from the point where the urban district boundary intersects the southern side of the road.

( h ) The Killeigh or Mountmellick Road for a distance of 243 metres from the point where the urban district boundary intersects the eastern side of the road.

( i ) The Charleville Road between the urban district boundary and a point 10 metres south-east of the junction of Cormac Street with Back Road.

( j ) Chancery Lane between the urban district boundary and a point 165 metres from its junction with the Killeigh or Mountmellick Road.

SECOND SCHEDULE.

Roads in the County of Offaly declared to be public roads in a built-up area for the purposes of Section 45 of the Road Traffic Act, 1961 .

1. The following roads at Ballycumber:--

( a ) The Clara-Ferbane road between a point 460 metres west of its junction with the Middle Road and the eastern end of east of the said junction.

( b ) The Moate Road for a distance of 395 metres from its junction with the Clara-Ferbane road.

2. The following roads at Banagher:--

( a ) Curraghvarna Road, Church Street.

( b ) The Birr-Eyrecourt road between a point 80 metres south of its junction with the Middle Road and the eastern end of Banagher Bridge.

( c ) Cuba Avenue between its junction with the Birr-Eyrecourt road and a point 10 metres east of its junction with Curraghvarna Road.

( d ) Harbour Street and its continuation as the Cloghan Road for a distance of 715 metres from the junction of Harbour Street with the Birr-Eyrecourt road.

( e ) The Crank Road for a distance of 101 metres from its junction with the Birr-Eyrecourt road.

( f ) Queen Street and its continuation as the Lusmagh Road for a distance of 595 metres from the junction of Queen Street with the Birr-Eyrecourt road.

( g ) The Coolfin Road for a distance of 175 metres from its junction with the Birr-Eyrecourt road.

3. The following roads at Bracknagh:--

( a ) The Portarlington-Clonbullogue road between a point 85 metres north of its junction with the Rathangan Road and a point 705 metres south-west of the said junction.

( b ) The Rathangan Road for a distance of 280 metres from its junction with the Portarlington-Clonbullogue road.

4. The following roads at Clara:--

All roads in the area enclosed by a line commencing at a point on the Athlone Road 238 metres north-west of its junction with Oratory Row and drawn thence in straight lines successively to the following points:--

( a ) a point on Church Road 69 metres north of its junction with the road connecting the northern end of the Fair Green with the Tullamore-Athlone road,

( b ) a point on the Kilbride Road 229 metres north-east of its junction with the Square,

( c ) a point on the Kilbeggan Road 485 metres east of its junction with the Tullamore Road,

( d ) a point on the Tullamore Road 110 metres south-east of its junction with Frederick Street,

( e ) a point on New Road 92 metres south-west of its junction with Frederick Street,

( f ) a point on the Ballycumber Road 1,326 metres south-west of its junction with New Road,

( g ) a point on the road connecting Oratory Row with the Athlone Road at Bogtown 23 metres north-west of its junction with Oratory Row

and from the last-mentioned point in a straight line to the commencement point on the Athlone Road.

5. The following roads at Cloghan:--

( a ) The Ferbane-Birr road between a point 220 metres north-east of its junction with the Tullamore-Shannonbridge road and a point 366 metres south-west of the said junction.

( b ) The Tullamore-Shannonbridge road between a point 230 metres east of its junction with the Ferbane-Birr road and a point 275 metres north-west of the said junction.

( c ) The Banagher Road for a distance of 183 metres from its junction with the Ferbane-Birr road.

6. The following roads at Clonbullogue:--

( a ) The Green.

( b ) The Bracknagh-Edenderry road between a point 380 metres north of its junction with the Rathangan Road and a point 325 metres south-west of the said junction.

( c ) The Rathangan Road for a distance of 165 metres from its junction with the Bracknagh-Edenderry road.

( d ) The Daingean Road for a distance of 35 metres from its junction with the Bracknagh-Edenderry road.

7. The following roads at Daingean:--

( a ) The Tullamore-Edenderry road between the centre-point of Footbarrack Bridge and a point 101 metres west of its junction with Back Road.

( b ) The Ballycommon Road for a distance of 138 metres from its junction with the Tullamore-Edenderry road.

( c ) Chapel Lane for a distance of 366 metres from its junction with the Tullamore-Edenderry road.

( d ) The Rhode Road for a distance of 55 metres from its junction with the Tullamore-Edenderry road.

8. The following roads adjacent to the town of Edenderry:--

( a ) The Tullamore Road for a distance of 366 metres south-west from its junction with the Clonbullogue Road.

( b ) The Clonbullogue Road for a distance of 565 metres from its junction with the Tullamore Road.

( c ) The Cokery Road for a distance of 450 metres from its junction with the Tullamore Road.

9. The following roads at Ferbane:--

( a ) Delvin Park, Cannocks Terrace, Bord na Móna Housing Estate Road.

( b ) The Cloghan-Athlone road between a point 780 metres south of its junction with the Clare Road and a point 668 metres north of the said junction.

( c ) The Clara Road between its junction with the Cloghan-Athlone road and a point 10 metres west of its junction with the Coole Road.

( d ) The Belmont Road for a distance of 550 metres from its junction with the Cloghan-Athlone road.

10. The following roads at Geashill:--

( a ) The Portarlington-Tullamore road between a point 366 metres east of its junction with the Mountmellick Road and a point 101 metres north-west of the said junction.

( b ) The road on the south side of the Green.

( c ) The Mountmellick Road for a distance of 192 metres from its junction with the Portarlington-Tullamore road.

( d ) The Ballinagar Road for a distance of 230 metres from its junction with the Portarlington-Tullamore road.

11. The following roads at Kilcormac:--

( a ) Church Lane East, Fair Green Street, The Square.

( b ) The Tullamore-Birr road between a point 555 metres north-east of its junction with the Square and a point 92 metres south-west of its junction with the Firealley Road.

( c ) The Ballyboy Road for a distance of 440 metres from its junction with the Square.

( d ) The Kinnitty Road and its continuation as the Money Road between the junction of the Kinnitty Road with the Square and a point 46 metres south-west of the junction of the Money Road with the Derrinboy Road.

( e ) The road connecting Fair Green Street with the Tullamore-Birr road.

( f ) Mountrath Street and its continuation as the Derrinboy Road between the junction of Mountrath Street with the Tullamore-Birr road and a point 147 metres south-east of the junction of the Derrinboy Road with the Money Road.

( g ) The Firealley Road for a distance of 92 metres from its junction with the Tullamore-Birr road.

( h ) The Ferbane Road for a distance of 46 metres from its junction with the Tullamore-Birr road.

( i ) Kilnagall Lane for a distance of 138 metres from its junction with the Tullamore-Birr road.

12. The following roads at Killeigh:--

( a ) Church Lane.

( b ) The Tullamore-Mountmellick road between a point 37 metres west of its junction with Church Lane and a point 23 metres south-east of its junction with the Clonygowan Road.

( c ) The Clonygowan Road for a distance of 92 metres from its junction with the Tullamore-Mountmellick road.

( d ) The Mountbolus Road between its junction with the Tullamore-Mountmellick road and a point 46 metres south-west of its junction with Church Lane.

( e ) The Ballinagar Road for a distance of 165 metres from its junction with the Tullamore-Mountmellick road.

13. The following roads at Kinnitty:--

All roads in the area enclosed by a line commencing at a point on the Cadamstown Road 435 metres east of its junction with the Longford Road and drawn thence in straight lines successively to the following points:--

( a ) a point on the Walk Road 55 metres north of its junction with the Birr-Cadamstown road,

( b ) a point on the Kilcormac Road 175 metres north-west of its junction with the Birr-Cadamstown road,

( c ) a point on the Birr Road 185 metres west of its junction with the Longford Road,

( d ) a point on the Longford Road 220 metres south of its junction with the Birr-Cadamstown road,

( e ) a point on the Castletown Road 115 metres east of its junction with the Birr-Cadamstown road,

and from the last-mentioned point in a straight line to the commencement point on the Cadamstown Road.

14. The following roads at Moneygall:--

( a ) St. Joseph's Terrace.

( b ) The Dublin-Limerick road between a point 46 metres north-east of its junction with St. Joseph's Terrace and a point 46 metres west of its junction with the Cloughjordan Road.

( c ) The Castletown Road between its junction with the Dublin-Limerick road and a point 46 metres east of its junction with St. Joseph's Terrace.

( d ) The Army Hill Road for a distance of 23 metres from its junction with the Dublin-Limerick road.

( e ) The Cloughjordan Road for a distance of 183 metres from its junction with the Dublin-Limerick road.

15. The following roads at Mountbolus:--

( a ) The Kilcormac-Blacklion road between a point 75 metres south-west of its junction with the Garbally Road and a point 290 metres north-west of the said junction.

( b ) The Garbally Road for a distance of 65 metres from its junction with the Kilcormac-Blacklion road.

( c ) The Clonaslee Road for a distance of 95 metres from its junction with with Kilcormac-Blacklion road.

16. The following roads at Portarlington:--

( a ) St. Mary's Terrace.

( b ) Patrick Street and its continuation to the boundary between the counties of Offaly and Laoighis at the Barrow Bridge.

( c ) The Clonygowan Road for a distance of 655 metres from its junction with the Mountmellick Road.

( d ) The Mountmellick Road for a distance of 105 metres from its junction with the Clonygowan Road.

( e ) The Kilmalogue Road for a distance of 55 metres from its junction with the Clonygowan Road.

( f ) Botley Lane for a distance of 10 metres from its junction with Patrick Street.

17. The following roads at Rhode:--

( a ) The Mullingar-Portarlington road between a point 631 metres north of its junction with the Croghan-Edenderry road and a point 330 metres south of the said junction.

( b ) The Croghan-Edenderry road between a point 275 metres west of its junction with the Mullingar-Portarlington road and a point 640 metres east of the said junction.

18. The following road at Riverstown:--

The Birr Road for a distance of 360 metres from the boundary between the counties of Tipperary North Riding and Offaly at Riverstown Bridge.

19. The following roads at Shinrone:--

( a ) St. Mary's Terrace for a distance of 305 metres from its junction with the Sharavogue-Cloughjordan road.

( b ) The Roscrea Road for a distance of 366 metres from its junction with the Sharavogue-Cloughjordan road.

( c ) The Brosna Road for a distance of 355 metres from its junction with the Sharavogue-Cloughjordan road.

( d ) The Sharavogue-Cloughjordan road between a point 570 metres north of its junction with the Roscrea Road and a point 915 metres south-west of the said junction.

20. The following road adjacent to the Urban District of Tullamore:--

Adams Villas.

THIRD SCHEDULE.

Roads in the County of Offaly in respect of which a special limit of 40 miles per hour is prescribed.

1. The following roads at Belmont:--

( a ) The High Street-Ferbane road between a point 265 metres east of its junction with the Cloghan-Clonfanlough road and a point 325 metres west of the said junction.

( b ) The Cloghan-Clonfanlough road between a point 170 metres north of its junction with the High Street-Ferbane road and a point 225 metres south of the said junction.

2. The following roads in the Urban District of Birr:--

( a ) Orchard Lane.

( b ) The Kinnitty or Syngefield Road between a point 782 metres north-west of its junction with the Whiteford Road and a point 92 metres north-west of the said junction.

( c ) Moorpark Road between its junction with the Roscrea Road and a point 5 metres north of its junction with Orchard Lane.

3. The following road at Clara:--

The Kilbeggan Road between a point 485 metres east of its junction with the Tullamore Road and a point 1,735 metres east of the said junction.

4. The following roads at Clonygowan:--

( a ) The Fair Green.

( b ) The Portarlington-Tullamore road between a point 330 metres north-west of its junction with the Mountmellick Road and a point 20 metres south-east of its junction with the Bogtown Road.

5. The following road at Daingean:--

The Rhode Road between a point 55 metres north of its junction with the Tullamore-Edenderry road and a point 357 metres north of the said junction.

6. The following roads in the town of Edenderry:--

( a ) The Cush Road between a point 1,252 metres north-west of the town boundary and a point 823 metres north-west of the said boundary.

( b ) The Dublin Road between a point 233 metres south-west of the town boundary and a point 914 metres south-west of the said boundary.

7. The following roads at Ferbane:--

( a ) The Athlone Road between a point 668 metres north of its junction with the Clara Road and a point 1,290 metres north of the said junction.

( b ) The Belmont Road between a point 550 metres west of its junction with the Cloghan-Athlone road and a point 1,830 metres west of the said junction.

( c ) The Endrim Road for a distance of 60 metres from its junction with the Cloghan-Athlone road.

8. The following roads at Horseleap:--

( a ) The Moate Road between the boundary between the counties of Westmeath and Offaly and a point 185 metres north-west of its junction with the Mullingar Road.

( b ) The Mullingar Road for a distance of 55 metres from its junction with the Moate Road.

( c ) The Clara Road for a distance of 120 metres from its junction with the Moate Road.

9. The following roads at Screggan and Mucklagh:--

( a ) The Tullamore-Birr road between a point 80 metres west of the centre line of Mucklagh Bridge and a point 80 metres south-west of its junction with the Rahan Road.

( b ) The Rahan Road at Screggan Cross for a distance of 35 metres from its junction with the Tullamore-Birr road.

( c ) The Blacklion Road at Screggan Cross for a distance of 30 metres from its junction with the Tullamore-Birr road.

( d ) The Lynally Road for a distance of 155 metres from its junction with the Tullamore-Birr road.

( e ) The Brackagh Road for a distance of 30 metres from its junction with the Tullamore-Birr road.

10. The following roads at Shannonbridge:--

( a ) St. Ciaran's Park.

( b ) The Ballinasloe-Cloghan road between the eastern end of the bridge over the river Shannon and a point 320 metres south-east of its junction with the Clonmacnoise Road.

11. The following roads in and adjacent to the Urban District of Tullamore:--

( a ) The Clara Road between a point 438 metres south-east of the boundary of the urban district of Tullamore and a point 25 metres north-west of the said boundary.

( b ) The Kilbeggan Road between a point 438 metres south-east of the boundary of the urban district of Tullamore and a point 75 metres north of its junction with Collin's Lane.

( c ) The Charleville Road between a point 10 metres south-west of its junction with Dillon Street and a point 10 metres south-west of its junction with Coleman's Terrace.

( d ) The Killeigh or Mountmellick Road between a point 243 metres north from the point where the boundary of the urban district of Tullamore intersects the western side of the road and a point 10 metres north of its junction with Coghlan's Lane.

( e ) The Daingean Road between a point 566 metres west of the boundary of the urban district of Tullamore and a point 366 metres east of the said boundary.

( f ) The Rahan Road between a point 850 metres south-east from the point where the boundary of the urban district of Tullamore intersects the western side of the road and a point 65 metres north-west of the point where the said boundary intersects the eastern side of the road.

( g ) The Portarlington Road between a point 685 metres west of the point where the boundary of the urban district of Tullamore intersects the southern side of the road and a point 20 metres west of the said point.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County of Offaly) Regulations, 1968 ( S.I. No. 132 of 1968 ) and the Road Traffic (Speed Limits) (County of Offaly) (Amendment) Regulations, 1972 ( S.I. No. 27 of 1972 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the courses of duty are excepted from all speed limits by the Regulations.
