TRADE UNION (FEES) REGULATIONS, 1978.

I, DESMOND O'MALLEY, Minister for Industry, Commerce and Energy, in exercise of the powers conferred on me by section 13 of the Trade Union Act, 1871, as adapted by section 2 of the Registry of Friendly Societies Act, 1936 (No. 51 of 1936), and section 13 of the Trade Union Act, 1975 (No. 4 of 1975), and the Industry and Commerce (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 306 of 1977 ), hereby, with the consent of the Minister for Finance and with the consent of the Minister for Labour, insofar as these Regulations relate to fees chargeable under the said Trade Union Act, 1975 , make the following Regulations:

1. These Regulations may be cited as the Trade Union (Fees) Regulations, 1978.

2. These Regulations shall come into operation on the 14th day of April, 1978.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. (1) The fees specified in Part I of the Schedule of these Regulations shall be payable in respect of matters to be transacted or for the inspection of documents under the Trade Union Acts, 1871 to 1975, other than matters to be transacted under the Trade Union Act, 1975 (No. 4 of 1975).

(2) The fees specified in Part II of the Schedule shall be payable in respect of matters to be transacted under the Trade Union Act, 1975 .

(3) No fee shall be payable in respect of the services specified in Part III of the schedule to these Regulations.

5. Regulation 24 of the Regulations dated November 1, 1876, made by the Secretary of State, as amended by Regulations dated April 29, 1890, made by the Secretary of State, is hereby revoked.

5. Authentication of a document required to be authenticated by the Registrar which is not chargeable with any other fee 1.00
6. Inspection of trade union file 0.12
Provided that the Registrar may dispense with the fee in cases where he considers that it is in the public interest so to do.
7. Copy or extract of any document (in addition to fee for Registrar's signature)
Such fee as may be fixed by the Registrar.

PART II.

PART III.

1. Cancellation or withdrawal of certificate of registry of trade union.

2. Filing of notice of change of registered office.

3. Any document supplied to a public department.

4. Any document in respect of which a fee is already chargeable under the Trade Union Acts, 1871 to 1975, or under any other Act.

EXPLANATORY NOTE.

The purpose of these Regulations is to increase the fees to be paid for matters to be transacted or for the inspection of documents under the Trade Union Acts, 1871 to 1975.
