EUROPEAN COMMUNITIES (PROVISIONAL ANTI-DUMPING DUTIES) (MISCELLANEOUS SUSPENSIONS) REGULATIONS, 1978.

EUROPEAN COMMUNITIES (PROVISIONAL ANTI-DUMPING DUTIES) (MISCELLANEOUS SUSPENSIONS) REGULATIONS, 1978.

I, DESMOND O'MALLEY, Minister for Industry, Commerce and Energy, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Recommendation No. 714/78/ECSC 1 of the 6th day of April, 1978, hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Provisional Anti-Dumping Duties) (Miscellaneous Suspensions) Regulations, 1978.

(2) These Regulations shall be deemed to have come into operation on the 8th day of April, 1978.

2. The provisional anti-dumping duty imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Certain Sheets and Plates of Iron or Steel) (No. 2) Regulations, 1978 ( S.I. No. 64 of 1978 ), on goods of the description specified in Regulation 3 (1) of those Regulations shall not be charged or levied on goods of that description which are imported into the State and which originate in Japan.

3. The provisional anti-dumping duty imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Certain Sheets and Plates of Iron or Steel) (No. 4) Regulations, 1978 ( S.I. No. 67 of 1978 ), on goods of the description specified in Regulation 3 (1) of those Regulations shall not be charged or levied.

4. The provisional anti-dumping duty imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Iron or Steel Coils for Re-rolling) (No. 2) Regulations, 1978 ( S.I. No. 68 of 1978 ), on goods of the description specified in Regulation 3 (1) of those Regulations shall not be charged or levied on goods of that description which are imported into the State and which originate in Japan.

5. The provisional anti-dumping duty imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Certain Angles, Shapes and U, I or H Sections of Iron or Steel) (No. 2) Regulations, 1978 ( S.I. No. 70 of 1978 ), on goods of the description specified in Regulation 3 (1) of those Regulations shall not be charged or levied.

6. The provisional anti-dumping duty imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Certain Galvanised Steel Sheets and Plates) Regulations, 1978 ( S.I. No. 72 of 1978 ), on goods of the description specified in Regulation 3 (1) of those Regulations shall not be charged or levied on goods of that description which are imported into the State and which originate in Japan.

7. For the purposes of these Regulations, the country of origin of goods shall be determined in accordance with the rules of origin contained in Council Regulation EEC No. 802/682 of the 27th day of June, 1968 (as amended).

EXPLANATORY NOTE.

These Regulations provide for the suspension of the application of the provisional anti-dumping duties imposed by the five Regulations referred to in paragraphs (2), (3), (4), (5) and (6) above in relation to or in so far as they relate to imports of certain iron or steel products originating in Japan.
