HARBOUR RATES (NEW ROSS HARBOUR) ORDER, 1980.

HARBOUR RATES (NEW ROSS HARBOUR) ORDER, 1980.

I, ALBERT REYNOLDS, Minister for Transport, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Transport and power (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 305 of 1977 ) and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ) and after due compliance with section 106 of that Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (New Ross Harbour) Order, 1980.

(2) This Order shall come into operation on the 1st day of February, 1980.

2. In this Order--

"the Order of 1974" means the Harbour Rates (New Ross Harbour) Order, 1974 ( S.I. No. 359 of 1974 );

"the Order of 1977" means the Harbour Rates (New Ross Harbour) Order, 1977 ( S.I. No. 5 of 1977 ).

3. The Harbour Rates (New Ross Harbour) Order, 1949 ( S.I. No. 230 of 1949 ), is hereby amended by--

( a ) The substitution for the First Schedule (inserted by the Order of 1974) thereto of the following:

"FIRST SCHEDULE

( b ) the substitution for the Second Schedule (inserted by the Order of 1977) thereto of the following:

"SECOND SCHEDULE

ACTUAL TONNAGE RATES

Ref. No. Description of Charge Rate
1. Tonnage rates on vessels other than those described in paragraphs 2 to 7 below inclusive:

( a ) on every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel discharging or loading in the harbour

( b ) on every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel entering and leaving the harbour without cargo, or entering and leaving the harbour with the same cargo, or for the purpose of seeking refuge

( c ) on every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel lying up in the harbour after the expiration of 2 days for each succeeding week or part thereof

2. On every river craft which plies regularly between any point in Waterford harbour and New Ross harbour or within the limits of New Ross harbour an annual sum payable yearly in advance on the 1st January of £20.00
3. On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel, barge or lighter constructed in New Ross and exported through the port to any port or place 25p
4. On every passenger carrying vessel, other than seagoing passenger vessels, operating in the Port of New Ross an annual sum payable in advance on the 1st January of £25.00p
5. On every hired Cruiser entering or leaving the Port of New Ross a sum of £2.00
6. On every pleasure craft entering or leaving the Port of New Ross an annual sum payable in advance on the 1st January of £3.00
7. On every open salmon boat, an annual sum payable in advance on the 1st January of £1.50 "

( c ) the substitution for the Third Schedule (inserted by the Order of 1977) thereto of the following:

"THIRD SCHEDULE

ACTUAL SERVICE RATES

1. For mooring or unmooring ships at the Commissioners' wharves and jetties, per ship ... £7.50
2. For the attendance of the Harbour Constable at loading or unloading of hazardous cargoes

£5.00 per hour

or

so much of the remuneration of the Constable as is attributable to the time spent by him in attendance during the loading or discharging whichever is the greater sum.

3. For the provision of fresh water at the Commissioners' wharves ... ... ... 45p per 5,000 litres, together with any labour charges incurred.
4. Wharfage Rates
At the Commissioners' permanent wharves and jetties 50% of the appropriate goods rate."

and (d) the substitution for the Fourth Schedule (inserted by the Order of 1974) thereto of the following:

"FOURTH SCHEDULE

OTHER CHARGES (ACTUAL)

Ref. No. Description of Charge Rate
1. For the use of any wharf, pier, quay, shed or other storage area, for any period, for storage of any goods, for each week or part thereof, per tonne or per square metre at the option of the Commissioners 25p
2. For the storage of imported fully built up motor vehicles in the Commissioners' Compounds for any number up to a maximum of 5,000 vehicles per annum, per vehicle £1.10p "

4. Paragraphs (b), (c), (d) and (e) of Article 2 of the Order of 1974, and the Order of 1977 are hereby revoked.

EXPLANATORY NOTE.

This Order authorises the charging of increased goods, tonnage and service rates and other charges at New Ross Harbour.
