BRUCELLOSIS IN CATTLE ORDERS (AMENDMENT) ORDER, 1980.

BRUCELLOSIS IN CATTLE ORDERS (AMENDMENT) ORDER, 1980.

I, RAY MacSHARRY, Minister for Agriculture, in exercise of the powers conferred on me by sections 3 , 13 , 19 , 20 and 27 of the Diseases of Animals Act, 1966 (No. 6 of 1966), as adapted by the Agriculture and Fisheries (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 31 of 1977 ), hereby order as follows:--

1. (1) This Order may be cited as the Brucellosis in Cattle Orders (Amendment) Order, 1980.

(2) This Order shall come into operation on the 25th day of June, 1980.

2. Article 3 (1) of the Brucellosis in Cattle (Disease Free Area) Order, 1968 ( S.I. No. 112 of 1968 ), as amended by Article 2 of the Brucellosis in Cattle (Disease Free Area) (Amendment) Order, 1970 ( S.I. No. 29 of 1970 ), and Article 2 of the Brucellosis in Cattle (Disease Free Area) (Amendment) Order, 1972 ( S.I. No. 120 of 1972 ), is hereby amended by the substitution of "counties of Cavan, Donegal, Galway, Leitrim, Mayo, Monaghan, Roscommon and Sligo" for "counties of Cavan, Donegal, Leitrim, Mayo, Monaghan and Sligo" and the said Article 3 (1), as so amended, is set out in the Table to this Article.

3. (1) Such area as consists of the administrative counties of Cavan, Donegal, Galway, Leitrim, Mayo, Monaghan, Roscommon and Sligo (in this Order referred to as the area) is hereby declared to be an area in which Brucellosis in cattle is virtually non-existent.

3. Article 8 (1) of the Brucellosis in Cattle (Movement Control) Order, 1970 ( S.I. No. 135 of 1970 ), is hereby amended by--

( a ) the insertion of "female animal aged less than twelve months or" before "eligible" in subparagraph (a);

( b ) the insertion of "female animals aged less than twelve months or the" before "eligible" in subparagraph (b);

and the said subparagraph (a) and the said subparagraph (b), as so amended are set out in paragraphs 1 and 2, respectively, of the Table to this Article.

TABLE

1. No female animal aged less than twelve months or eligible animal shall, except under permit under this Article, be moved into or out of the herd,

2. the owner or person in charge of the herd shall surrender to an inspector of the Minister or to an authorised officer any identity cards or brucellosis certified cards issued by the Minister in respect of the female animals aged less than 12 months or the eligible animals in the herd,

4. Article 8 (1) of the Brucellosis in Cattle (Movement Control) Order, 1973 ( S.I. No. 132 of 1973 ), is hereby amended by--

( a ) the insertion of "female animal aged less than twelve months or" before "eligible" in subparagraph (a);

( b ) the insertion of "female animals aged less than twelve months or the" before "eligible" in subparagraph (b);

and the said subparagraph (a) and the said subparagraph (b), as so amended, are set out in paragraphs 1 and 2, respectively, of the Table to this Article.

TABLE

1. No female animal aged less than twelve months or eligible animal shall, except under permit under this Article, be moved into or out of the herd,

2. the owner or person in charge of the herd shall surrender to an inspector of the Minister or to an authorised officer any identity cards or brucellosis certified cards issued by the Minister in respect of the female animals aged less than 12 months or the eligible animals in the herd,

5. The Brucellosis in Cattle (General Provisions) Order, 1979 ( S.I. No. 251 of 1979 ), is hereby amended by the substitution of the following Article 6:

"6 (1) An eligible animal in the area shall not be exposed at a public show or sale of cattle or be moved into or out of a herd otherwise than direct to a premises at which it is to be slaughtered unless the person in charge of the animal has in his possession a permit issued by the Minister or a certificate issued by a veterinary surgeon showing that the animal has passed a test within the period of thirty days ending on the day on which the animal is so exposed or moved.

(2) An inspector who is a veterinary surgeon or an authorised officer may require the person in charge of an animal being exposed at a public show or sale in the area or being moved into or out of a herd in the area to produce for inspection the permit or certificate referred to in paragraph (1) of this Article and issued as regards the animal, and in case a requirement is made under this paragraph, the person of whom it is made shall forthwith comply with the requirement".

6. Where there is for the time being in force an order under section 19 of the Diseases of Animals Act, 1966 (No. 6 of 1966), declaring (in relation to brucellosis in cattle) an area to be either a clearance area or a disease-free area and there is in the area a herd in which there is for the time being an animal which an inspector appointed by the Minister believes to be or suspects of being infected with brucellosis in cattle, the Minister may in such manner as he considers appropriate cause the existence of such brucellosis in cattle to be brought to the notice of such occupiers of land as he considers appropriate.

7. (1) Where any person, other than its owner, moves, or causes to be moved, a reactor for slaughter, the following provisions shall apply:

( a ) the person shall neither transport nor cause to be transported in the same vehicle with the reactor any animal which is not a reactor.

( b ) if it is moved for slaughter in a vehicle, the person in charge of the vehicle shall, prior to acceptance at the premises at which it is to be slaughtered, neither off-load it nor cause it to be off-loaded, and

( c ) the person in charge of the vehicle used to move the reactor for slaughter shall ensure that the vehicle is cleansed and disinfected immediately following the delivery of the reactor to the premises at which it is to be slaughtered.

(2) No animal, hay, straw, fodder, roots or other feeding stuff shall be carried on a vehicle used to carry a reactor unless prior to such carriage such vehicle has been cleansed and disinfected.

(3) In this Article "reacter" means an animal which, by reason of the result of a test or otherwise, an inspector appointed by the Minister believes or suspects to be affected with brucellosis in cattle.

EXPLANATORY NOTE.

This Order (1) extends the Brucellosis Free Area to include counties Galway and Roscommon, (2) prohibits the movement of any female animals out of restricted herds in the Clearance Area, (3) provides for the issue of a certificate or permit showing that an animal has passed a 30-day test, (4) provides for the notification of adjoining herdowners of the existence of brucellosis in a herd and (5) lays down certain conditions relating to the transport of brucellosis reactors.
