I, ALBERT REYNOLDS, Minister of Transport, in exercise of the powers conferred on me by Section 104 of the Harbours Act, 1946 (No. 9 of 1946), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), and after due compliance with section 106 of that Act, hereby order as follows:-

1. (1) This Order may be cited as the Harbour Rates (Wicklow Harbour) Order, 1981.
|
|
|
(2) This Order shall come into operation on the 28th day of February, 1981.
|
|
|
2. (1) The Harbour Rates (Wicklow Harbour) Order, 1949 ( S.I. No. 172 of 1949 ), is hereby amended by--
|
|
|
(a) the substitution for the First Schedule (inserted by the Harbour Rates (Wicklow Harbour) Order, 1977 ( S.I. No. 262 of 1977 ), of the following:

(a) On every ton of the net register tonnage or half the gross tonnage, whichever is the greater, of every vessel entering the harbour:

Rates on fishing vessels: |
|
|
(a) As a composition in full in lieu of tonnage rates on every fishing vessel entering the harbour for the purpose of landing fish, per year:

(b) On every fishing vessel entering the harbour for any purpose other than landing fish, for each entry:
|
£2.80 |
|
The rate at 2(b) is chargeable for each stay in the harbour of seven days or part thereof.

3. |
Rates on Pleasure Boats: |
|
|
(a) On every open pleasure boat of 1 ton gross or under as a composition in full in lieu of tonnage rates payable yearly in advance, a sum not exceeding:
|

(b) On every decked or part decked pleasure boat of 1½ tons gross or under as a composition in full in lieu of tonnage rates payable yearly in advance, a sum not exceeding:

(c) On every decked or part decked pleasure boat of 10 tons gross or under but over 1½ tons gross as a composition in full in lieu of tonnage rates payable yearly in advance, a sum not exceeding:

(d) On every decked or part decked pleasure boat over 10 tons gross as a composition in full in lieu of tonnage rates payable yearly in advance, a sum not exceeding:

(e) On all pleasure boats entering the harbour and not paying the composition rates at reference number 3 (a), (b), (c), or (d), over and remaining in the harbour less than 7 days:

for vessels remaining in the harbour between 7 and 14 days a further:

for vessels remaining in the harbour between 14 and 21 days a further:

|
(2) Where rates fixed under this Order are payable at a metric tonne charge, lesser weights shall be chargeable as follows:
|
|
|
(a) any weight not exceeding 250 kilogrammes shall count as 250 kilogrammes,
|
|
|
(b) any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall count as 500 kilogrammes,
|
|
|
(c) any weight exceeding 500 kilogrammes but not exceeding 750 kilogrammes shall count as 750 kilogrammes,
|
|
|
(d) any weight exceeding 750 kilogrammes but not exceeding 1 tonne shall count as 1 tonne.

EXPLANATORY NOTE
|
|
|
This Order authorises the Wicklow Harbour Commissioners to charge revised goods, tonnage and other rates at Wicklow Harbour.
