S.I. No. 152/1981:

ROAD TRANSPORT ACT, 1978 (SECTION 5) ORDER, 1981.

I, ALBERT REYNOLDS, Minister for Transport, in exercise of the powers conferred on me by section 5 of the Road Transport Act, 1978 (No. 8 of 1978), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), hereby order as follows:

1. This Order may be cited as the Road Transport Act, 1978 (Section 5) Order, 1981.

2. The class of international transport by road which is specified in paragraph (d) of Article 5 of the agreement made on the 26th day of February, 1981, between the Government and the Government of the Kingdom of Denmark on the international carriage of goods by road (being an international agreement relating to international transport by road), and which is set out in the Schedule to this Order, is hereby exempted from the provisions of section 7 of the Road Transport Act, 1935 (as amended or extended).

SCHEDULE

Class of International Transport by Road Referred to in Paragraph 2

Carriage of goods on own account, provided that an appropriate own account document, in a form agreed by the competent authorities of the Countracting Parties to the agreement referred to in paragraph 2, is carried on the vehicle.

EXPLANATORY NOTE.

The effect of this Order is that a licence under Section 7 of the Road Transport Act, 1935 is not required in respect of the class of international transport by road specified in paragraph (d) of Article 5 of the Road Transport Agreement between the Government and the Government of the Kingdom of Denmark dated 26th February, 1981, viz. carriage of goods on own account provided an appropriate own account document is carried on the vehicle.
