HOUSING REGULATIONS, 1980, (AMENDMENT) (No. 2) REGULATIONS, 1981. |

The Minister for the Environment in exercise of the powers conferred on him by section 5 of the Housing Act, 1966 (No. 21 of 1966) and by section 5 of the Housing (Miscellaneous Provisions) Act, 1979 (No. 27 of 1979), with the consent of the Minister for Finance, hereby makes the following Regulations-- |

1. These Regulations may be cited as the Housing Regulations, 1980 (Amendment) (No. 2) Regulations, 1981. |
||
2. In these Regulations-- |
||
"the Regulations of 1980" means the Housing Regulations, 1980 ( S.I. No. 296 of 1980 ). |
||
3. Article 14 of the Regulations of 1980 is hereby amended by the substitution therein for sub-article (3) of the following sub-article-- |
||
"(3) ( a ) Save in respect of grants payable in accordance with paragraphs (d) (i) of article 16 (1), (a) of article 16 (3), (c) and (d) of article 19 (3) and paragraph (a) (i) of article 20 (1), the amount of a grant shall not exceed the maximum grant specified or two thirds of the approved cost of the works whichever is the less. |
||
( b ) In respect of grants payable in accordance with paragraphs (d) (i) of article 16 (1), (c) and (d) of article 19 (3) and paragraph (a) (i) of article 20 (1) the amount of a grant shall not exceed the maximum grant specified or 80 per cent of the approved cost of the works whichever is the less." |
||
4. Article 16 of the Regulations of 1980, is hereby amended by the substitution therein for paragraph (d) of sub-article (1) of the following paragraph-- |
||
"( d ) (i) £600, for the provision and installation of a private water supply in a house, located in the Region described in the Fifth Schedule as part of a group water supply scheme, where there is no existing water supply in the house or where the existing water supply is, in the opinion of the Minister, seriously deficient and where not less than 35% of the members of the group scheme are farmers or inhabitants of villages who are dependent principally on agriculture, |

(ii) in any other case, £300, for the provision and installation of a private water supply in a house as part of a group water supply scheme, where there is no existing water supply in the house or where the existing water supply is in the opinion of the Minister, seriously deficient." |

5. Article 16 of the Regulations of 1980, is hereby further amended by the addition thereto of the following sub-article-- |
||
"(7) The provisions of paragraph (d) (i) of sub-article (1) shall not apply as respects works commenced before the 15th day of April, 1981 and after the 31st day of December, 1983". |
||
6. Sub-article (3) of article 19 of the Regulations of 1980, is hereby amended by the addition thereto of the following paragraphs-- |
||
"( c ) £750, where the house is located on an island specified in Part 1 of the Second Schedule and where the island is located in the Region described in the Fifth Schedule and where not less than 35% of the members of the group scheme are farmers or inhabitants of villages who are dependent principally on agriculture. |
||
( d ) £840, where the house is located on an island specified in Part 11 of the Second Schedule and where the island is located in the Region described in the Fifth Schedule and where not less than 35% of the members of the group scheme are farmers or inhabitants of villages who are dependent principally on agriculture." |

7. Article 19 of the Regulations of 1980 is hereby further amended by the addition thereto of the following sub-article-- |
||
"(5) the provisions of paragraphs (c) and (d) of sub-article (3) shall not apply as respects works commenced before the 15th day of April, 1981, and after the 31st day of December, 1983." |
||
8. Article 20 of the Regulations of 1980 is hereby amended by the substitution therein for paragraph (a) of sub-article (1) of the following paragraph-- |
||
"( a ) (i) £600, for the provision and installation of a private water supply in a house, located in the Region described in the Fifth Schedule, as part of a group water supply scheme, where there is no existing water supply in the house or where the existing water supply is, in the opinion of the Minister, seriously deficient and where not less than 35% of the members of the group scheme are farmers or inhabitants of villages who are dependent principally on agriculture. |

9. Article 20 of the Regulations of 1980 is hereby further amended by the addition thereto of the following sub-article-- |
||
"(4) The provisions of paragraph (a) (i) of sub-article (1) shall not apply as respects works commenced before the 15th day of April, 1981 and after the 31st day of December, 1983." |
||
10. The Regulations of 1980, are hereby amended by the addition thereto of the following schedule-- |
||
"FIFTH SCHEDULE |
||
The Western Region being the region consisting of all of the counties of Cavan, Clare, Donegal, Galway, Kerry, Leitrim, Longford, Mayo, Monaghan, Roscommon, Sligo and |
||
-- the following parts of the county of Cork |
||
-- the former rural distrists of Bantry, Castletown, Skull and Skibbereen. |
||
-- the District Electoral Divisions of Aultagh, Bealanageary, Bealock Carrigboy, Coolmountain, Dunmanway North, Garrown and Milane in the former rural district of Dunmanway. |
||
-- the District Electoral Divisions of Clonfert East and Clonfert West, Kilmeen, Knockatooan, Rowls, Williamstown, Barnacurra, Glenlara, and Meens in the former rural district of Kanturk. |
||
-- the District Electoral Divisions of Bealanageary, Candroma, Cleanrath, Clondrohid, Derryfineen, Gurtnatubbrid, Inchigeelagh, Kilberrihert, Kilnamartery, Rahalisk, Slievereagh and Ullanes in the former rural district of Macroom. |
||
-- the District Electoral Divisions of Caherbarnagh, Coomlogane and Drishane in the former rural district of Millstreet; and |
||
-- the following parts of the county of Limerick |
||
-- the District Electoral Divisions of Kilfergus and Kilmoylan in the former rural district of Glin. |
||
-- the District Electoral Divisions of Abbeyfeale, Caher, Dromtrasna, Glenagower, Glensharrold, Mountcollins, Port, Rathronan, Rooskagh and Templeglentan in the former rural district of Newcastle. |
||
-- the District Electoral Divisions of Dunmoylan West and Mohernagh in the former rural district of Rathkeale and; |
||
-- the Islands specified in the Second Schedule." |

EXPLANATORY NOTE |
||
These Regulations amend the Housing Regulations, 1980, to provide for increases in the maximum grants payable by the Minister for the Environment, for the installation of water supplies in dwelling houses located in the Western Region as part of a group water supply scheme, where work commences on or after the 15th day of April, 1981 and before the 31st day of December, 1983. |
||
The increased grants are being financed with assistance from the European Agricultural Guidance and Guarantee Fund (F.E.O.G.A.) under Regulation E.E.C. No. 1820/80 of 24th June, 1980, (O.J. L 180/1 of 14th July, 1980) for the stimulation of agricultural development in the less-favoured farming areas of the Western Region which is set out in the Fifth Schedule of the Regulations and which accords with the definitions in Directive No. 75/272/E.E.C., of 28th April, 1975 (O.J. No. L 128 of 19/5/75). Decision No. 77/5/E.E.C., of 13th December, 1976 (O.J. No. L 3 of 5/1/77) and Decision No. 8¼7/E.E.C., of 12th January, 1981 (O.J. No. L 50 of 25/2/81). |
