S.I. No. 415/1985:

TELEPHONE (AMENDMENT) (NO. 4) SCHEME 1985.

TELEPHONE (AMENDMENT) (NO. 4) SCHEME 1985.

Bord Telecom Éireann, in exercise of the powers conferred on it by Section 90 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), hereby makes the following Scheme:

1. (1) This Scheme may be cited as the Telephone (Amendment) (No. 4) Scheme, 1985.

(2) The collective citation "The Telephone Schemes 1980 to 1985" shall include this Scheme.

2. This Scheme shall be deemed to have come into operation on 1st September 1985.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Scheme.

4. The Telephone Regulations, 1980 ( S.I. No. 195 of 1980 ), are hereby amended by:

( a ) the insertion of the following definition after that of "coin box exchange line" in Regulation 4(1): "'Eircell Equipment" shall have the meaning assigned to it by paragraph 5 of the Eircell Scheme 1985 ( S.I. No. 414 of 1985 );'

( b ) the substitution of the following definition for that of "reverse charge call" in Regulation 4(1): "'reverse charge call" means a call between telephones in the State or between a telephone in the State and a telephone outside the State where the person making the call requests the telephone exchange operator that the charge or charges payable in respect of the call (save any personal charge in case the call is made from a coin-box exchange line) shall be charged to and payable by the person who is the subscriber in respect of the called telephone and the telephone exchange operator obtains from the person answering on the called telephone a consent to the request before the call is established and, for this purpose, the term "telephone" includes Eircell Equipment or analogous equipment outside the State and "call" includes a call, to or from such Eircell Equipment or such analogous equipment;'

( c ) the insertion of the following new Regulation after Regulation 10:

'10A In respect of every subscriber dialled call (including a subscriber dialled trunk call) made from the fixed telephone network to Eircell Equipment and to which call Regulation 10 and the First and Second Schedules to these Regulations would apply if it had been to a telephone within the said fixed telephone network the charges applicable to the said call shall nevertheless be governed by the said Regulation 10 and the Second Schedule to these Regulations as if the call were to a telephone within the said fixed telephone network save that in the case of calls between exchanges in the State and from exchanges in the State to exchanges in Northern Ireland the period of time appropriate to the call shall in all cases irrespective of distance be that specified at paragraph 1 (iii) of the Table to the said Second Schedule.'

( d ) the insertion of the following new Regulation after Regulation 11;

'11A In respect of every call made from the fixed telephone network to Eircell Equipment and to which call Regulation 11 and the Third and Fourth Schedules to these Regulations would apply if it had been to a telephone within the said fixed telephone network the charges applicable to the said call shall nevertheless be governed by the said Regulation 11 and the Third and Fourth Schedules (as the case may be) to these Regulations as if the call were to a telephone within the said fixed telephone network save that in the case of calls between exchanges in the State and from exchanges in the State to exchanges in Northern Ireland the period of time appropriate to the call shall in all cases irrespective of distance be that specified in respect of distances exceeding 80 kilometres.'
