DISTRICT COURT DISTRICTS AND AREAS (AMENDMENT) AND VARIATION OF DAYS AND HOURS ORDER, 1988.

DISTRICT COURT DISTRICTS AND AREAS (AMENDMENT) AND VARIATION OF DAYS AND HOURS ORDER, 1988.

I, GERARD COLLINS, Minister for Justice, in exercise of the powers conferred on me by section 26 of the Courts of Justice Act, 1953 (No. 32 of 1953), and after consultation with the President of the District Court, hereby order as follows:

1. (1) This Order may be cited as the District Court Districts and Areas (Amendment) and Variation of Days and Hours Order, 1988.

(2) This Order shall come into operation on the 1st day of April, 1988.

2. In this Order "the Principal Order" means the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ).

3. The Principal Order is hereby amended by the deletion of the matter at reference number 154 in columns (2), (3), (4) and (5), respectively, in the First Schedule thereto.

4. The First Schedule to the Principal Order is hereby amended by--

(a) the substitution for the matter in column (2) at reference number 153 of the following:

"County and

County Borough of Limerick and

county of Clare".

(b) the substitution for the matter in column (4) (as amended by the District Court Areas (Variation of Days and Hours) (No. 2) Order, 1969 ( S.I. No. 31 of 1969 ), and the District Court Areas (Variation of Days and Hours) (No. 3) Order, 1984 ( S.I. No. 216 of 1984 )) at the said reference number of the following:

"First, Second, Third and

Fourth Wednesday and

Fourth Tuesday in

each month at 10.30 a.m.,

12 noon and 2.30 p.m.

Each Thursday at

10.30 a.m., 12 noon

and 2.30 p.m.

Second Tuesday in

February, April, June,

October and December

at 10.30 a.m., 12 noon

and 2.30p.m.

(First Wednesday in

each month at 10.30 a.m.

(Children's Court)).", and

(c) the substitution for the matter in column (5) at the said reference number of the following:

"(a) the County Borough of Limerick,

(b) the District Electoral

Divisions of Ballybricken,

Ballycummin, Ballysimon,

Ballyvarra, Caherconlish

West, Caherelly,

Castleconnell, Fedamore,

Kilpeacon, Limerick North

Rural, Limerick South

Rural and Roxborough in

the county of Limerick,

and

(c) the District Electoral

Divisions of Ballyglass,

Cappavilla, Cloghera and

Kiltenanlea in the county

of Clare.".

5. The First Schedule to the District Court (Districts) Order, 1961 ( S.I. No. 6 of 1961 ), is hereby amended by the deletion in column (3) at reference number 14 of "Limerick Rural,".

6. The Schedule to the District Court Areas (Amendment) Order, 1970 ( S.I. No. 161 of 1970 ), is hereby amended by the deletion in column (4) at reference number 14 of "Limerick Rural," and "154,".

7. Business transacted in the District Court which is initiated and is not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business was initiated.

EXPLANATORY NOTE.

This Order provides for the abolition of the District Court Area of Limerick Rural and the amalgamation of its business with that of Limerick City. It also provides for additional sitting days and alterations in the times of sittings of the District Court in Limerick City.
