MEMBERS OF THE OIREACHTAS AND MINISTERIAL AND PARLIAMENTARY OFFICES (ALLOWANCES AND SALARIES) ORDER, 1988

The Government, in exercise of the powers conferred on them by section 3A of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938) (inserted by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by sections 6,8 and 9 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1983 (No. 32 of 1983), and section 8A of the Ministerial and Parliamentary Offices, Act, 1938 (No. 38 of 1938) (inserted by section 11 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by section 7 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977) and sections 6 , 8 and 9 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1983 (No. 32 of 1983), hereby make the following Order.

1. This Order may be cited as the Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 1988.

2. In this Order--

"the Act of 1938" means the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938);

"the Act of 1973" means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973);

"the Act of 1977" means the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977).

3. The allowance payable monthly under subsection (1)

(inserted by the Act of 1973) of section 3 of the Oireachtas (Allowances to Members) Act, 1938 , to each member of Dáil Éireann shall, with effect from the 1st day of July 1988, be and be deemed to have been £22,661 per annum and the allowance payable monthly to each member of Seanad Éireann under subsection (2) (inserted by the Act of 1973) of the said section 3 shall, with effect from the said 1st day of July 1988, be and be deemed to have been £12,631 per annum.

4. The annual sum payable by way of salary under subsection (1) (inserted by the Act of 1973) or subsection (2) (inserted by the Act of 1977) of section 3 of the Act of 1938 shall, with effect from the 1st day of July 1988, be and be deemed to have been a sum not exceeding--

( a ) in the case of the Taoiseach, £38,465

( b ) in the case of the Tánaiste, £28,344

( c ) in the case of a member of the Government, other than the Taoiseach or the Tánaiste, £25,308

( d ) in the case of a Minister of State appointed under section 1 of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 , £14,170.

5. The annual sum payable by way of salary under section 4 (inserted by the Act of 1973) of the Act of 1938 to the Attorney General shall, with effect from the 1st day of July 1988, be and be deemed to have been a sum not exceeding--

( a ) in case the person who holds the office is not a member of either House of the Oireachtas, £40,883,

( b ) in case a member of either House of the Oireachtas holds the office, £25,308.

6. The annual sum payable by way of salary under subsection (1) (inserted by the Act of 1973) of section 5 of the Act of 1938 to the Chairman of Dáil Éireann shall, with effect from the 1st day of July 1988, be and be deemed to have been a sum not exceeding £25,308 and the annual sum so payable under the said section 5 (1) to the Deputy Chairman of Dáil Éireann shall, with effect from the said 1st day of July 1988, be and be deemed to have been a sum not exceeding £14,170.

7. The annual sum payable by way of salary under subsection (1) (inserted by the Act of 1973) of section 6 of the Act of 1938 to the Chairman of Seanad Éireann shall, with effect from the said 1st day of July 1988, be and be deemed to have been a sum not exceeding £10,540, and the annual sum payable under the said section 6 (1) to the Deputy Chairman of Seanad Éireann shall, with effect from the said 1st day of July 1988, be and be deemed to have been a sum not exceeding £5,983.

8. The annual sums payable under section 9A (inserted by the Act of 1973) and section 10 (as amended by the Act of 1973) of the Act of 1938 by way of allowance for expenses, shall, with effect from the 1st day of July 1988, he and be deemed to have been--

( a ) in the case of the sum payable under subsection (1) of the said section 9A, £96,991,

( b ) in the case of the sum payable under paragraph (a) of subsection (2) of the said section 9A, £67,914,

( c ) in the case of the sum payable under paragraph (b) of subsection (2) of the said section 9A, £29,148,

( d ) in the case of the sum payable under paragraph (a) of subsection (3) of the said section 9A, £48,532,

( e ) in the case of the sum payable under paragraph (b) of the said subsection (3), £48,532, divided in the manner specified in that paragraph,

( f ) in the case of the sum payable under subsection (1) of the said section 10, £242,368,

( g ) in the case of the sum payable under paragraph (a) of subsection (2) of the said section 10, £192,501,

( h ) in the case of the sum payable under paragraph (b) of the last-mentioned subsection (2), £95,581,

( i ) in the case of the sum payable under paragraph (a) of subsection (3) of the said section 10, £138,814, and

( j ) in the case of the sum payable payable under paragraph (b) of the last-mentioned subsection (3), £156,409, divided in the manner specified in that paragraph.

EXPLANATORY NOTE.

This Order applies to certain salaries and allowances, with effect from 1 July 1988, the increase recommended in the interim report dated 24 November 1986 of the Review Body on Higher Remuneration in the Public Sector.
