AIR NAVIGATION (PROTECTION AREA) ORDER, 1989.

AIR NAVIGATION (PROTECTION AREA) ORDER, 1989.

I, JOHN P. WILSON, Minister for Tourism and Transport, being of the opinion that the unrestricted use of the area of land described in Article 2 of this Order in the vicinity of Connaught Regional aerodrome would interfere with navigation of aircraft flying to or from that aerodrome, in exercise of the powers conferred on me by section 14 of the Air Navigation and Transport Act, 1950 (No. 4 of 1950), and the Communications (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order, 1987 ( S.I. No. 92 of 1987 ), hereby order as follows:

1. (1) This Order may be cited as the Air Navigation (Protection Area) Order, 1989.

(2) This Order shall come into operation on the 18th day of May, 1989.

2. The area of the land that is--

( a ) situated in the townland of Kilgarriff West, in the county of Mayo, and

( b ) shown enclosed within the inner margin of the black line and hatched in black on the map set out in the Schedule to this Order,

is hereby declared to be a protected area for the purposes of this Order.

3. It is hereby declared that a person shall not, within the protected area, save under and in accordance with a permit granted by the Minister for Tourism and Transport,

( a ) erect or add to any building, or

( b ) erect or place any post, pole or other thing, so that any part of the building, post, pole or other thing will be at a height greater than 1 metre.

EXPLANATORY NOTE.

This Order establishes a protected area of 300 metres radius around the Doppler Very High Frequency Omni-Directional Radio Range and Distance Measuring Equipment which is sited at Kilgarriff West, Charlestown in County Mayo. This equipment provides navigational information to aircraft flying to or from Connaught Regional Airport or those within the North West Quadrant of the Shannon Flight Information Region. The Minister may grant permits where any proposed development within the protected area would not interfere with the navigation of aircraft flying to or from Connaught Regional Airport or those within the North West Quadrant of the Shannon Flight Information Region.
